<br />RESOLUTION NO. <br /> <br />C-B7-99 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY <br />APPROVING THE "THIRD AMENDMENT TO THE AMENDED JOINT POWERS <br />AGREEMENT THAT ESTABLISHED THE ALCOHOL VIOLATION TEMPORARY <br />HOUSING AUTHORITY": <br /> <br />RESOLVED, by the City Council of the City of Half Moon Bay, California, that: <br /> <br />WHEREAS. the City Council in September 1991, entered into the original Joint <br />Powers Agreement that established the Alcohol Violation Temporary Housing Authority <br />program to provide a drinking driver and public inebriate drop-off center; and <br /> <br />WHEREAS, the City Council adopted the first (1 o>t) amendment to the Original <br />Agreement in April 1993, and the second amendment was adopted in June 1994; and <br /> <br />WHEREAS, it is now the mutual desire and intent of the parties of the Joint <br />Powers Agreement to amend and clarify the Original Agreement a third (3rd) time; and <br /> <br />WHEREAS, it has been determined that it is in the best interest of the City to <br />amend the funding formula in the Agreement and establish a Cost of Living Adjustment <br />in said formula; and <br /> <br />WHEREAS, the City Council has been presented with a form of the Agreement <br />and has examined and approved it as to both fonn and content and desires to enter <br />into the Agreement: <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF HALF MOON BAY hereby: <br /> <br />1.
