� i�- � <br /> REPOR <br /> T <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> September 26, 2005 <br /> Subject <br /> Consultant Agreement - Mark Thomas & Company, Inc. for the Landscaping of the <br /> Ralston Avenue/Marine Parkway/Route 101 Interchange Reconfiguration Project. <br /> Recommendation <br /> Approve and authorize an agreement with Mark Thomas & Company, Inc., for providing <br /> supplemental design services for the Landscaping of the Ralston Avenue/Marine <br /> Parkway/Route 101 Interchange Reconfiguration Project, in an amount not to exceed <br /> $59,060. <br /> Background <br /> Mark Thomas & Company (MTCo) is the Engineer of Record for the main interchange <br /> reconfiguration project, and was chosen as the design consultant after an intensive <br /> selection process. The construction of this project is nearing completion and this <br /> agreement will allow the consultant to finalize the landscape Contract Documents. <br /> Typically, the landscaping is included as part of a construction project for all City <br /> projects. In this case, Caltrans has specifically instructed staff to separate this task <br /> from the main interchange construction contract, due to a specific requirement in their <br /> Standard Specifications, and a commitment that they made to the contracting <br /> community. <br /> Caltrans requires a three year plant establishment period, which puts all the <br /> maintenance responsibilities on the Contractor (the City requires only one year) and ties <br /> up the Contractor's bonding capacity for that entire three-year period of time. The <br /> contracting community cannot accept this, not only because they cannot effectively <br /> close out a completed project, but the bond for the entire project has to be maintained <br /> in effect. With this understanding, Caltrans is now bidding the landscaping portion of <br /> the improved areas separately, in order to alleviate this situation. <br /> In the original design contract, MTCo had the landscaping design as a"scope of work," <br /> and lead the design effort for the landscaping up to the 65% review level, at which time, <br /> Caltrans decided that the landscaping package should be pulled out of the main <br /> construction contract. MTCo's design effort, up to that point, was paid for under the <br /> original design agreement. The original design agreement was subsequently amended <br /> to add construction support activities, which are on going; thus, that agreement is still in <br /> effect. The balance of the fees for the landscaping design was re-allocated to other <br /> tasks. Staff feels that a new agreement is advantageous, because the original <br /> Page 1 of 2 <br />
