EXHIBIT A <br /> TO CONSTRUCTION AND REIMBURSEMENT AGREEMENT FOR THE <br /> STREETSCAPE IMPROVEMENTS AND STREET MODIFICATIONS <br /> CITY OF REDWOOD CITY <br /> A. SCOPE OF WORK <br /> Developer shall perForm the following Services in accordance with the <br /> Construction and Reimbursement Agreement for the Streetscape Improvements and <br /> Street Modifications. <br /> 1. Award of Contracts for Construction. <br /> A. Developer shall obtain at least three (3) competitive bids for each <br /> construction trade or discipline involved in construction of the Streetscape <br /> Improvements and Street Modifications in general conformance with the <br /> City of Redwood City's procurement requirements, or, if Developer cannot <br /> obtain three bids after diligent efforts to do so, Developer shall otherwise <br /> satisfy City and Agency that the price for a particular trade or discipline is <br /> fair and reasonable. Developer shall provide City and Agency with copies <br /> of any and all bids promptly upon written request. <br /> B. As provided in Attachment 8 of the DDA, the cost of constructing the <br /> Streetscape Improvements and Street Modifications will be based on the <br /> lowest responsive, responsible bids received. If Developer, City and <br /> Agency wish to accept a bid other than the lowest responsive, responsible <br /> bid for any part of the Streetscape Improvements and Street Modifications, <br /> Developer shall be responsible for identifying cost savings acceptable to <br /> the City and Agency to offset the costs. <br /> C. Upon receipt of bids for the construction of the Streetscape Improvements <br /> and Street Modifications, the total value of the lowest responsive, <br /> responsible bids will be compared with the Not-to-Exceed Streetscape <br /> Improvement Cost. If the total of these bids causes the Cost of the Work <br /> to exceed the amount set forth in Paragraph �(A� of the Agreement, <br /> Developer shall immediately notify the City and Agency. Developer, City <br /> and Agency shall meet and confer to identify adjustments to the cost or <br /> scope of the Streetscape Improvements and Street Modifications to bring <br /> the cost of construction within the Not-to-Exceed Streetscape <br /> Improvement Cost. Developer shall implement such cost reductions as <br /> are acceptable to City and Agency. Developer will not award any contract <br /> for construction of the Streetscape Improvements and Street Modifications <br /> until Developer, City and Agency have reached a final, documented <br /> agreement on each party's responsibility for the cost of construction. <br /> D. Developer shall notify City and Agency in writing of the name of each <br /> Contractor with whom it enters into a contract in connection with <br /> 840847v8 33786/0001 <br />
