<br />(m) The Parking Requirement for the Accessory Building Parcels shall be <br />deemed satisfied by the parking provided for the Common Parcels and Pacific Shores may <br />specify portions of the parking on or for Common Parcels to be allocated to and reserved for <br />the use of a specific Accessory Building Parcel, which allocations shall be set forth in Final <br />Development Plans. <br /> <br />(n) The overall nwnber of parking spaces on Building Parcels shaH be <br />limited to the Parking Requirement (as potentially adjusted per the foregoing subsections) <br />except as follows: <br /> <br />(i) Pacific Shores may designate additional spaces to be signed for <br />visitor use to serve nearby Common Parcels and/or Accessory Building Parcels; <br /> <br />(ii) Pacific Shores may request and the City may approve, by adoption or <br />amendment of a Final Development Plan, to provide additional spaces where the City <br />determines that they are needed; or <br /> <br />(iil) Pacific Shores may request and the: City may approve, by adoption or <br />amendment of a Final Development Plan, conversion of all or a portion of any area <br />designated on Exhibit B-6 as Parking Reserve, as modified by any Final Development <br />Plan, to parking use upon a showing by Pacific Shores that an increase in parking over <br />the Parking Requirement is necessary to meet the parking needs of the uses on one or <br />more Building Parcels or accessory Building Parcels. <br /> <br />(0) In the event that a child care facility has not been built on the <br />Accessory Building Parcel designated for such purpose by the time that fifty-five percent <br />(55%) of the GBF A permitted for the Project has been occupied, the City and Pacific Shores <br />shall meet to discuss alternative potential uses of such parcel and, if an agreement is reached <br />between the City and Pacific Shores regarding a suh5rtimte use, then Pacific Shores shall make <br />payment of mutually agreed compensation to the City for the approval of the substitute use, <br />with such compensation to be applied by the City to the provision of child care programs, <br />services or facilities elsewhere in the city. <br /> <br />5. <br /> <br />Project Timing. <br /> <br />(a) Subject to Section 3 Pacific Shores may develop the Building Parcels <br />and the Accessory Building Parcels in the order and at the times Pacific Shores, in its sole <br />ùi:Sl;rclÏuIl, ùt:t:m:s appruprialt:: bi1:SCÙ UIl Pi:1dfic Shun::s' analysb uf Lhust: fal;lurs ùt:Lt:ilnining, <br />in Pacific Shores' judgment, the appropriate pace and timing of the development of the <br />Project. <br /> <br />(b) The adoption or modification of any Development Regulation or <br />Building Regulation by City, whether by initiative or otherwise, limiting or prescribing the <br />pace or timing of development or construction v.ithin City is in conflict with this Agreement, <br /> <br />., \"""\..'"".13\"""\°'"."'" <br /> <br />16 <br /> <br />,...,..-....
