<br />WHEREAS, the construction of said sanitary sewerage treatment <br /> <br />facilities is to be funded by Federal and State grants, together with <br /> <br />local public funds, but the capacity of said facilities so grant- <br /> <br />funded to treat sewage is restricted by Federal and State regulations <br /> <br />implementive of the Federal Water Pollution Control Act, as amended; <br /> <br />and <br /> <br />WHEREAS, grant eligible capacity and non-grant eligible capacity <br /> <br />(which terms are hereinafter defined) is available in the amounts and <br /> <br />under the terms and conditions hereinafter specified to treat sewage <br /> <br />which may emanate from lands situate within the Emerald Lake Hills <br /> <br />Area; and <br /> <br />WHEREAS, the new sanitary sewerage treatment facilities are <br /> <br />designed to include sufficient capacity to accommodate the anticipated <br /> <br />requirements for treatment of sewage which may emanate from the lands <br /> <br />within the Emerald Lake Hills Area, but not to exceed the maximum <br /> <br />amounts hereinafter specified; and <br /> <br />WHEREAS, the parties hereto desire to provide for the allocation <br /> <br />and use of sanitary sewerage treatment ca~acity for the benefit of <br /> <br />properties situate within the Emerald Lake Hills Area, subject to <br /> <br />all of the terms and conditions hereinafter set forth; <br /> <br />NO~v, THEREFORE, in consideration of the above premises and the <br /> <br />mutual promises herein contained, the parties hereto agree as follows: <br /> <br />1. <br /> <br />DEFINITIONS. <br /> <br />The following words or phrases wherever used <br /> <br />ln this agreement shall have the meanings hereinafter respectively <br /> <br />ascribed thereto: <br /> <br />(a) <br /> <br />Authority.
