<br />( 1) <br /> <br />(m) <br /> <br />2. <br /> <br />Related Districts. Sewer maintenance districts, or <br />qther public agencies, the purpose of which is to <br />provide, maintain, replace or repair sanitary sewerage <br />collection, transmission, pumping, and any other <br />facility or facilities necessary or convenient to the <br />collection and transmission of sewage, emanating from <br />a portion, but not the entire territory, of the Emerald <br />Lake Hills Area upon the date hereof, or which after <br />said date are established. In accordance with the <br />foregoing definition, Related Districts include, <br />but are not limited to, the Oak Knoll Sewer Maintenance <br />District and the Kensington Square Sewer Maintenance <br />District. <br /> <br />Sewage. Waste and wastewater as defined and described in <br />those ordinances, rules, regulations, resolutions, orders, <br />or directives, and any amendments or revisions thereto, <br />enacted by City, the other constituent agencies of Authority, <br />and County, uniform in substance, and establishing standards, <br />conditions, and other regulations, relating to the use of <br />such enacting agencies' and Authority's sewerage facilities. <br /> <br />GRANT ELIGIBLE CAPACITY RIGHTS. <br /> <br />(a) <br /> <br />Allocation. <br /> <br />The <br /> <br />parties hereto acknowledge that City has provided grant eligible <br /> <br />capacity in the design of 7\uthority's troiìtment plant to treiJ.t sewage <br /> <br />emanating from lands situate within the Emerald Lake Hills Area in the <br /> <br />following amounts: <br /> <br />0.2 mgd, 334 lbs/day BODS' and 334 lbs/day TSS. <br /> <br />City hereby acknowledges that, on and after the operative date of <br /> <br />Authority's treatment plant, and subject to the terms and conditions <br /> <br />hereof, City shall provide not less than the aforementioned grant <br /> <br />eligible capacity rights for the benefit of lands situate within <br /> <br />the Emerald Lake Hills Area. <br /> <br />(b) <br /> <br />Title. <br /> <br />Title to the aforesaid grant eligible capacity <br /> <br />rights is, and shall remain at all times, vested in City; provided, <br /> <br />however, that said grant eligible capacity rights shall be reserved <br /> <br />and provided for the benefit of lands situate within the Emerald Lake <br /> <br />Hills Area, as aforesaid. <br /> <br />Notwithstanding the foregoing, County <br /> <br />shall allocate all, and all portions of, said grant eligible capacity <br /> <br />rights to lands or activities within said Area as the same exists <br /> <br />upon the date hereof and, subject to the provisions of paragraphs 6 and <br /> <br />7, said grant eligible capacity rights shall remain so allocated for <br /> <br />-5- <br />
