<br />Staff Recommendations: <br /> <br />a) <br /> <br />Amend the Development Agreement between the City and Flatirons Funding, <br />Limited Partnership, by removing Parcel B from the provisions of the <br />Development Agreement since it is no longer owned by Flatirons Funding with <br />the following condition: <br /> <br />1) Shorebreeze Associates shall "not protest the formation of the traffic <br />assessment district in Redwood Shores (to be evidenced by an agreement.) <br /> <br />2) Amend the Development Agreement between the City and Flatirons Funding, <br />Limited Partnership, to: a) add some common area properties acquired by <br />Flatirns Funding, Limited Partnership, (subsequent to the approval of the <br />Development Agreement,) to the provisions of the Development Agreement; <br />and b) remove the common area properties transferred to Shores Business <br />Center Association (subsequent to the approval of the Development <br />Agreement) from the provisions of the Development Agreement. <br /> <br />3) Recommendation Number 3 is required so that all of the property now owned <br />by Flatirons Funding, Limited Partnership, is encumbered by and subject to <br />the existing Development Agreement with Flatirons, and the new common <br />area lots now owned by the Shores Business Center Association are not <br />encumbered and subject to the existing Development Agreement with <br />Flatirons Funding, Limited Partnership. <br /> <br />MOTION: Uphold the appeal with or without conditions; deny the appeal; deny the <br />appeal and amend the Planned Development Permit as recommended by staff; or <br />approve other actions deemed appropriate; <br /> <br />7. <br /> <br />MATTERS OF COUNCIL INTEREST <br /> <br />This item limited to fifteen minutes. <br /> <br />A.
