Mr. Aguilar mentioned that prior to digging, he would be <br />contacting V. Fontana and Company to determine the necessary technical <br />information about the exhumation. The digging would probably be done by <br />City staff and would involve digging down 18"-24" in depth. <br /> <br />Chairperson Truscelli asked if Mr. Maguire has offered to pay the expense of <br />exhumation and Mr. Aguilar said the department will assume the expense. <br />Mr. Aguilar explained that we are going solely on Mr. Maguire's word that <br />the urn is buried where it is. Mr. Maguire buried the urn himself and did not <br />obtain permission to do so. It was suggested using a metal detector to confirm <br />the location of the urn. Commissioner Davis felt there is a liability issue and <br />wanted to make sure we are legally entitled to proceed with this request. <br />Commissioner Hughes felt that because of the circumstances surrounding the <br />burial, the documents submitted by Mr. Maguire, and that there is no way to <br />verify that the urn is where Mr. Maguire says it is, the Commission should <br />not be approving this ,request. Mr. Aguilar stated Mr. Maguire took him to <br />the actual spot where he buried the urn. Commissioner Swope suggested <br />checking with V. Fontana and with the City Attorney regarding this matter. <br /> <br />M/S Davis/Swope: To approve the request of Mr. Maguire with the <br />stipulation that we verify the legal requirements with the City <br />Attorney and that we verify the technical requirements with <br />V. Fontana. <br />Vote taken: Yes-3 No-3 <br />Motion died due to a tie. <br /> <br />Superintendent Seleznow stated that staff would contact the City Attorney <br />and V. Fontana and will present the results of their research at the May <br />meeting. <br /> <br />Mr. Aguilar reviewed the results of the Union Cemetery Repair Project No.2 <br />with the Commissioners. He said the repair project was completed April 3 <br />and 5 by V. Fontana and Company and noted 53 monuments were repaired. <br />The bill for the repairs totaled $1,890.00 which averages $35.66 per <br />monument. The cost is shared 50/50 by HUCA and the department. To date, <br />78 monuments have been repaired at Union Cemetery. Mr. Aguilar <br />mentioned that a few of the repairs have been completed by one of the <br />department's landscape gardeners who has previous masonry experience. <br />Mr. Aguilar hoped that by the end of the year all repairs at Union Cemetery <br />would be completed. The Commissioners asked if anyone had brought back <br />headstones that were previously removed because of vandalism at the <br />cemetery and Mr. Aguilar stated that none had been returned. He said no <br />advertising has been done on the repair project in order to avoid vandalism. <br />Commissioner Swope asked if a special event would be held at Union <br />Cemetery after the repairs were completed and invitations sent to next of kin <br /> <br /> <br />. .. <br /> <br /> <br />" -', <br />- .
