Park & Recreation Commission
Minutes of June 25, 1997

Page 2

,-

The Commissioners agreed that people are in violation of the ordinances but
this is not a high priority for the Police Department as compared with other
crime matters. Mr. Rogers felt that the ordinance signage is not adequate in
most parks and should be changed. Director Griffiths estimated it would cost
$125 to $150 per sign to have them installed throughout our park system.
Commissioner Davis asked if staff could contact the Police Chief regarding
this matter and ask him to respond back to the Commission.

ITEM 1 - APPEAL OF TREE REMOVAL PERMIT FOR 129 CENTRAL
A VENUE

Lawana Pacini explained that she applied for a permit to remove 2 oak trees
and one walnut tree on her rental property at 129 Central Avenue and the
permit was denied by Public Works Services, and she is now appealing the
process. She stated she never planted the trees and that they grew voluntarily
in her front yard and are now too large for her 15' x 37' size yard. She said the
trees have been pruned several times but they are a continual problem
resulting in damage to the house foundation, and mold and weeds on the
roof. She spoke about termites being found in her property but the contractor
would not guarantee the work due to the close proximity of the trees. Mrs.
Pacini also contacted PG&E to see if they could trim the tree branches but they
denied her request.

Public Works Superintendent Gordon Mann reported the permit for the
removal of the walnut tree was granted but the removal of the oak trees was
denied. Mr. Mann explained the oak trees are in good condition, they add
screening, and are very visible on the street. He recommended that the trees
be pruned rather than removed. Mr. Mann noted it is not possible to
determine if the cracks in the foundation were attributable to the trees.

Commissioner Davis said he visited the site and felt that although the trees
are very visible in the neighborhood, he was concerned with the damage
done to the foundation of the house. Commissioner N ordness also visited
the site and felt the trees were eyesores and he measured only 12'-15' between
the two oak trees which are large in size. Commissioner Hughes visited the
site and was concerned about the tenant and the liability issue of falling tree
limbs. Chairperson Truscelli visited the site and felt the three trees were too
large for the small yard.

MIS Nordness/Morton: To accept the petition to approve the removal of
two oak trees at 129 Central Avenue.
Motion passed.
