<br />~+-/ <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />EXECUTIVE SUMMARY <br /> <br />Subject <br />Appeal of the Zoning Administrator's denial of a Use Permit at 150 EI Camino Real and 20 <br />Avondale Avenue to allow for the seasonal sale of pumpkins and Christmas trees from <br />October 1, 2005 through October 31, 2005, (for pumpkin sales) and from November 15, <br />2005 to January 5, 2006 (for Christmas tree sales). <br /> <br />Recommendation <br />That the City Council uphold the Zoning Administrator's decision and based on a review of <br />the staff report, administrative record and public testimony find that: <br /> <br />1. The placement of the proposed use on the subject site would, under the <br />circumstances of the particular case, be detrimental to the health, safety, peace, <br />morals, comfort, or general welfare of persons residing or working in the <br />neighborhood, as established in Article 42 Section 3 of the Redwood City Zoning <br />Ordinance. <br /> <br />2. The establishment and operation of the proposed use would be detrimental or <br />injurious to the general welfare of the City, as established in Article 42 Section 3 of <br />the Redwood City Zoning Ordinance. <br /> <br />Project Description <br />The applicant, Nicoll Enterprises, applied for a Use Permit to allow the seasonal sales of <br />pump~ins and Christmas trees from October 1, 2005 through October 31, 2005, (for <br />pumpkin sales) and from November 15, 2005 to January 5,2006 (for Christmas tree sales) <br />on two parcels located at 150 EI Camino Real and 20 Avondale Avenue. The combined <br />site area is approximately 19,550 square feet and both parcels are located within the <br />General Commercial - Combined Residential (CG-R) Zoning District. <br /> <br />Display of merchandise (Le. pumpkins and Christmas trees) would occur on the front <br />portion of the site closer to EI Camino Real. The site would also contain a trailer for staff <br />personnel and for security. The site would also contain two portable toilets, a 30 yard <br />dumpster, a tent (for tree flocking), several banners, and a series of poles to support light <br />strands. Customer access is provided via Avondale Avenue, while delivery truck loading <br />and unloading from the street is provided via an entrance on EI Camino Real or via an <br />existing driveway access on 20 Avondale Avenue. <br /> <br />Appellar't's Issues <br />The appellant disagrees with the Zoning Administrators decision and feels that the Zoning <br />Administrator's position is unsubstantiated. The use has been operated from this site for <br />nine years. The appellant has stated that with the implementation of additional mitigation <br />measures (see attachment 5), beyond the forty-three (43) conditions of approval <br />established in the 2004 Notice of Official Action which approved the use for that year, the <br />1 <br />
