<br />/4-9 <br /> <br />City staff has identified an alternative location within a mile and a halffrom the existing site <br />that could accommodate the proposed use. The alternative site has ample on site parking <br />and is located in a commercial district that is not directly adjacent to any residential <br />properties and therefore has been deemed a more appropriate site. <br /> <br />The location "a very short distance down EI Camino Real" that is located on an "even <br />smaller lot" is not within Redwood City's jurisdiction and therefore falls outside of the <br />purview of the Zoning Administrator's consideration. <br /> <br />. <br /> <br />Petition showing support of operation. <br /> <br />The appellant has submitted a petition with 177 signatures supporting the operation of the <br />proposed use on the subject property from 2004. Of the 177 signatures approximately 83 <br />(47%) signatures were from patrons that do not reside in Redwood City. Furthermore, not <br />one of the signatures is from a resident on Avondale Avenue. <br /> <br />Alternatives <br />1. Uphold the appeal, thereby allowing for the operation of the seasonal sales of <br />Christmas trees on the subject property from November 15, 2005 through January <br />5,2006. <br /> <br />2. <br /> <br />Deny appeal, thereby upholding the decision of the Zoning Administrator prohibiting <br />the seasonal sales of pumpkins and Christmas trees on the subject property. <br /> <br />Fiscal Impact <br />Staff has made estimates regarding the sales tax revenue generated by the Christmas tree <br />sales from this site based on the operator's statement about sales volume. In comparison <br />to staff time spent monitoring this use, allowing the Christmas tree lot will most certainly <br />result in a loss to the City of at least several hundred dollars and by as much as several <br />thousand dollars. <br /> <br />Conclusion <br />The Zoning Administrator, in conjunction with Community Development Services staff and <br />City Personnel, have documented a long-standing history of code violations and neighbor <br />complaints about the proposed use. In the past few years, staff has expended significant <br />time and effort toward making the use more compatible with the neighborhood. However, <br />despite these efforts, the use has proven to continue to be detrimental to the public health, <br />safety, peace, morals, comfort, or general welfare of persons residing or working in the <br />neighborhood. Furthermore, this determination for denying this use at this site does not <br />preclude the applicant from making an application to the City to operate the use at an <br />alternate, more appropriate site in the City. <br /> <br /> <br />/] (' ðJJ <br />\ ~1J/M~ <br /> <br />/íté!
