Approve the Improvement Plans and Subdivision Map for Toyon Way Subdivision, <br />accept the dedications, and approve and authorize execution of the Subdivision <br />Agreement. <br /> <br />2. Approve the Maintenance Agreement for Sewer and Stormwater Systems Faciliites. <br /> <br />Background <br />On March 24, 2003, the Planning Commission approved the Tentative Map for the <br />Toyon Way Subdivision, a 6-lot subdivision on a formerly dedicated (unimproved) street <br />near Vista Drive and Jefferson Avenue in Emerald Lake Hills. The filing of the final map <br />took a long time to prepare because the approval process was appealed by the <br />neighborhood, and the improvement plans went through several stages of review and <br />modification. The subdividers, Verne H. Brown, Ronald L. Brown, and Sharon L. Brown, <br />applied for and obtained a one-year extension on the tentative map approval due to the <br />length of time it took to clear the conditions for final map. They are now ready to record <br />the Final Subdivision Map for the project. <br /> <br />The subdivision also carries with it an agreement for the property owners to maintain <br />the on-site Sewer and Stormwater Facilities. This agreement is necessary for two <br />reasons: <br />1. The sewer and stormwater systems are private, and therefore require the <br />property owners to maintain them in proper order. <br /> <br />2. The stormwater facilites fall under the City's Stormwater Management and <br />Discharge Control Program (City Code Section 27 A), whereby property owners <br />are required to enter into operation and maintenance agreements for stormwater <br />treatment devices. <br /> <br />The subdivision consists of completing the installation of street improvements on Toyon <br />Way, plus the on-site improvements including grading, drainage, and sewer facilities to <br />serve the six lots. <br /> <br />The subdivider's engineers, Smith, Randlett, Foulk, and Stock, Inc., have completed the <br />Improvement Plans and Final Map respectively, in accordance with the Conditions of <br /> <br />Page 1 of 2 <br />
