<br />officers, employees and agents shall not be excess of Contractor's <br /> <br />insurance and shall not be contributory with it. <br /> <br />Such insurance shall also specifically insure any contractual liability <br /> <br />assumed by Owners under the terms of this Agreement, including, but <br /> <br />not limited to, the provisions of Paragraph 1 above. <br /> <br />5. <br /> <br />MONUMENTS. All pipes and monuments shown on the subdivision map <br /> <br />hereinafter referenced which are destroyed or displaced during construction operations <br /> <br />shall be replaced by Owners at the time of the final inspection of the Improvements, if <br /> <br />any, hereunder by City. <br /> <br />6. <br /> <br />OWNERSHIP AND MAINTENANCE OF IMPROVEMENTS. <br /> <br />It is agreed <br /> <br />that title and ownership of the improved public street, parking and walkway strip, <br /> <br />sanitary sewer laterals in city right-of-way, new street lights, new storm-drain piping, the <br /> <br />water services to the water meters and fire hydrant, constructed for the benefit of City <br /> <br />hereunder by Owners shall vest absolutely in City upon completion and acceptance of <br /> <br />such Improvements by City. <br /> <br />7. <br /> <br />WORK SUBJECT TO APPROVAL. <br /> <br />All work provided for in this <br /> <br />Agreement and more specifically described in the plans and specifications herein <br /> <br />referenced shall be subject to the approval and acceptance by the City Engineer, <br /> <br />Engineering and Construction before the release of any security required herein. <br /> <br />Reference is hereby made to (a) that certain Parcel Map No. 2005-04, (b) those certain <br /> <br />plans on file in the office of the City Engineer, Engineering and Construction entitled, <br /> <br />"Street Improvement Plan for 1021 and 1025 lakeview Way", and (c) those certain <br /> <br />specifications entitled, "Engineering Standards for the City of Redwood City", adopted <br /> <br />October 13, 2003, for a more particular description of the work and Improvements <br />Atty/Agr/2005.070 <br />091205 6 <br />
