recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of <br />compensation; and selection for training, including apprenticeship. <br />18. NONDISCRIMINATION BASED ON DISABILITY. Contractor hereby agrees <br />that it will comply with the provisions of Section 504 of the Rehabilitation Act of 1973, as <br />amended, and the American with Disabilities Act (ADA) providing equal access and <br />reasonable accommodations in employment programs and services to persons who are <br />disabled. <br />19. INTEREST OF PUBLIC OFFICIALS. No members, officers, or employees <br />or agents of the City of Redwood City, no member of the City Council and no other public <br />official who exercises any function or responsibility with respect to this Agreement, the <br />Property, or the Project during his or her tenure, or for one year thereafter, will have any <br />interest, direct or indirect, in this Agreement or a related subcontract, or the proceeds <br />thereof. Contractor will incorporate in all subcontracts hereunder a provision prohibiting <br />such interest. <br />20. LABOR CODE AND PREVAILING WAGE. Contractor agrees to be bound <br />by all applicable Labor Laws of the State of California and applicable Federal <br />requirements. A paragraph shall be incorporated in every agreement between Contractor <br />and third parties in connection to the Project stating that the third party must comply with <br />applicable California Labor Laws and Federal requirements. All laborers and mechanics <br />employed by Contractor or subcontractors in the performance of work financed in whole <br />or in part with funds received pursuant to this Agreement shall be paid wages at rates not <br />less than those prevailing on similar construction in the locality as determined by the <br />Secretary of Labor in accordance with the Davis -Bacon Act, as amended (40 U.S.C. <br />3141-3148). <br />21. GENERAL COMPLIANCE WITH LAWS. Contractor will keep fully informed <br />of and comply with federal, state and local laws and ordinances and regulations now in <br />ATTY/AGR/2018.027/MID PEN MOSIAC GARDENTS (ATHERTON COURT) <br />REV: 02-06-1815 <br />Page 15 of 41 <br />
