6.1.D. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />February 26, 2018 <br />SUBJECT <br />Approval of the General and Special Release to Resolve Litigation in Lambert v. City of <br />Redwood City <br />RECOMMENDATION <br />By motion, approve settlement as memorialized in the General and Special Release in <br />Lambert v. City of Redwood City <br />BACKGROUND <br />This is a lawsuit by Velma Lambert against the City of Redwood City arising out of a trip <br />and fall which allegedly occurred on or about February 10, 2015 on the sidewalk near <br />the intersection of Egret Lane and Redwood Shores Parkway. The parties reached a <br />global settlement, whereby the City would pay $65,500 in full and final settlement of all <br />claims. The terms have been memorialized in a General and Special Release signed by <br />Ms. Lambert and her attorney. <br />ANALYSIS <br />The City Attorney's Office recommends approval of the settlement as delineated in the <br />General and Special Release. <br />ALTERNATIVES <br />The City Council could elect not to approve the settlement. <br />FISCAL IMPACT <br />The settlement proceeds will be withdrawn from the City's general liability fund. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in the CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br />
