NO. 1986-1) <br /> <br />WHEREAS, <br /> <br />Underground <br /> <br />Utility <br /> <br />District <br /> <br />No. <br /> <br />1986-1 <br /> <br />(the <br /> <br />"District") has been established by this Council pursuant to the <br /> <br />provisions of Chapter 11, <br /> <br />Article II <br /> <br />(commencing with Section <br /> <br />11.30) of the Code of the City of Redwood City; and <br /> <br />WHEREAS, <br /> <br />Pacific Bell, <br /> <br />a California Corporation <br /> <br />(Pacific) <br /> <br />owns <br /> <br />certain <br /> <br />overhead <br /> <br />communications <br /> <br />facilities <br /> <br />within <br /> <br />said <br /> <br />district which, pursuant to regulations governing the District, <br /> <br />are required to be placed underground; and <br /> <br />WHEREAS, <br /> <br />an Agreement has been presented to, and reviewed <br /> <br />by, <br /> <br />this Council providing for the funding by Pacific of the <br /> <br />undergrounding of <br /> <br />the aforesaid <br /> <br />facilities <br /> <br />in connection with <br /> <br />certain construction to be carried out by the City within the <br /> <br />District; and <br /> <br />WHEREAS, this Council desires to approve and authorize the <br /> <br />execution of said Agreement, <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. <br /> <br />That <br /> <br />certain <br /> <br />agreement <br /> <br />by <br /> <br />and <br /> <br />between <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood City, a municipal corporation of the State of California, <br /> <br />and Pacific Bell, a California Corporation entitled, "Aerial to <br /> <br />Underground <br /> <br />Conversion <br /> <br />Agreement", <br /> <br />( form <br /> <br />dated <br /> <br />07/30/90) <br /> <br />providing <br /> <br />for <br /> <br />the <br /> <br />undergrounding <br /> <br />of <br /> <br />Pacific's <br /> <br />overhead <br />
