c. The project site has no value as habitat for endangered, rare, or <br />threatened species; and <br />d. Approval of the project would not result in any significant effects <br />related to traffic, noise, air quality, or water quality; and <br />e. The site can be adequately served by all required utilities and public <br />services. <br />Pursuant to Guidelines section 15091(e), the documents and other materials <br />that constitute the record of proceedings upon which the Planning Commission <br />has based its decision are located in and may be obtained from, the Office of the <br />City Clerk at 1017 Middlefield Road, Redwood City California. The City Clerk is <br />the custodian of records for all matters before the City. <br />Section 3. Planned Community permit PC2016-05: The Planning <br />Commission finds that: <br />a. The project and improvements proposed by Planned Community <br />permit PC2016-05 are consistent with, conform to the intent of, and <br />will appropriately implement the North Main Street Precise Plan for <br />the 353 Main St. project; and <br />b. The establishment, maintenance and operation of the project and <br />improvements proposed by Planned Community permit PC2016-05 <br />will not, under the circumstances of this particular case, be <br />detrimental to the public health, safety, peace, morals, or general <br />welfare of persons residing or working in the neighborhood of the <br />project, or be detrimental or injurious to property or improvements in <br />the neighborhood of the project, or to the general welfare of the City, <br />because the project has been found to be consistent with the <br />community goals established in the City's General Plan and Zoning <br />Ordinance; and <br />c. The height concession is consistent with the State Density Bonus <br />law, and the Project and improvements comply fully with all <br />applicable standards of the NMPP; and <br />Cl. The Project and improvements generally comply with the urban <br />design guidelines of the NMPP. The aspects of the Project which do <br />not conform to the guidelines of the NMPP (which are recommended, <br />not mandatory) nonetheless adequately promote the overall intent of <br />the NMPP. <br />Section 4. Affordable Housing Plan: The Planning Commission finds that: <br />a. The proposed Affordable Housing Plan conforms with Municipal Code <br />Chapter 18, Article XVII (Affordable Housing Impact Fee). The proposed <br />affordable units comply with the standards in Section 18.272, including <br />without limitation compliance with Section 18.272(8) requiring that the <br />affordable units be made available for occupancy concurrently with the <br />market -rate units in that the proposed affordable units would comply with the <br />required standards including providing a comparable quality of construction <br />ATTY/RESO.0017/PC RESO ADOPTING THE PLANNED COMMUNITY PERMIT & DENSITY BONUS -353 MAIN ST. <br />REV: 03-01-18 PR <br />Page 3 of 25 <br />
