Sewer Backup Into/Onto Private Property Claims Handling Policy <br /> <br />It is the policy of the City that a claims form shall be offered to anyone wishing to file a claim. The following <br />procedures will be observed for all sewer overflows/backups into/onto private property: <br /> <br />• City staff will offer a City claim form upon request, irrespective of fault, whenever it is possible that the <br />sanitary sewer backup may have resulted from an apparent blockage in the City-owned sewer lines or <br />whenever a City customer requests a claim form. The claim may later be rejected if subsequent <br />investigations into the cause of the loss indicate the City was not at fault. <br /> <br />• It is the responsibility of the Public Works Supervisor and the Maintenance Crew to gather information <br />regarding the incident and notify the City Risk Manager. <br /> <br />• It is the responsibility of the City Risk Manager to review all claims and to oversee the adjustment and <br />administration of the claim to closure. <br /> <br />11. Notification, Reporting, Monitoring and Recordkeeping Requirements <br /> ref. SWRCB Order No. 2006-0003-DWQ Element 6(c) <br /> <br />In accordance with the Statewide General Waste Discharge Requirements for Sanitary Sewer Systems (SSS <br />GWDRs), the City maintains records for each sanitary sewer overflow. Records include: <br />• Documentation of response steps and/or remedial actions <br />• Photographic evidence to document the extent of the SSO, field crew response operations, and site <br />conditions after field crew SSO response operations have been completed. The date, time, location, <br />and direction of photographs taken will be documented. <br />• Documentation of how any estimations of the volume of discharged and/or recovered volumes were <br />calculated including all assumptions made. <br />Regulator required notifications are outlined in Section 11.1 on the following page. <br />6.2.A. - Page 113
