<br />REV: 03-16-18 MI <br />ATTY/AGR/2018.054/RECOLOGY OF SAN MATEO <br />Page 35 of 119 <br />by the then-current per-Ton fee for transfer, transport, and Disposal pursuant to the 1341 <br />agreement between the SBWMA and Operator. 1342 <br />6.03 CONTRACTOR METHODS OF CONTROLLING CONTAMINATION 1343 <br />A. General. Contractor shall assist in controlling Contamination Levels by helping to 1344 <br />educate Customers on acceptable and non-acceptable materials, by monitoring the 1345 <br />contents of Collection Containers and by refusing to Collect Containers of Targeted 1346 <br />Recyclable Materials, Plant Materials, and Organic Materials that appear to exceed 1347 <br />the maximum Contamination Levels in Section 6.02 Table 1, all as and to the extent 1348 <br />set forth in this Section 6.03. 1349 <br />Drivers that dismount from Collection vehicles in order to empty Containers shall lift 1350 <br />the Container lid and observe the contents. If Contamination appears to be present 1351 <br />in excess of the applicable maximum Contamination Level, the driver will not empty 1352 <br />the Container, but will instead affix a “non-collection notice.” The non-collection 1353 <br />notice shall (i) inform the Customer of the reason(s) for non-collection, (ii) include the 1354 <br />date and time the notice was left, and (iii) describe the premium Charge to Customer 1355 <br />for Contractor to return and Collect the Container after Customer removes the 1356 <br />Contamination. The driver shall document the non-collection event and a customer 1357 <br />service representative shall update the Customer’s computerized account record to 1358 <br />note the event. Upon request from Customer, Contractor shall Collect Containers 1359 <br />that received non-collection notices within one (1) Business Day of Customer’s 1360 <br />request if the request is made at least two (2) Business Days prior to the regularly 1361 <br />scheduled Collection Day. Contractor shall bill Customer for the extra Collection 1362 <br />service event (“extra pick-up”) at Agency-approved Charges specified in Attachment 1363 <br />Q only if Contractor notifies Customer of the premium Charge for this service at the 1364 <br />time the request is made by Customer. 1365 <br />Drivers providing automated Collection service shall observe, via the hopper video 1366 <br />camera and monitor system, the contents of the Containers as it is being emptied into 1367 <br />the vehicle. If the driver observes Contamination in excess of the applicable 1368 <br />maximum Contamination Level, the driver shall affix a “courtesy notice” to the emptied 1369 <br />Container. The courtesy notice shall (i) inform the Customer of the observed presence 1370 <br />of unacceptable levels of Contamination, (ii) include the date and time the notice was 1371 <br />left, (iii) describe the premium charge to Customer for Contractor to return and Collect 1372 <br />Contaminated Containers after Customer removes the Contamination. The next day 1373 <br />on which that Customer is to receive service, the driver shall dismount the Collection 1374 <br />vehicle, lift the lid of the Container, and visually inspect the contents. If the driver 1375 <br />determines that the Container again contains excess Contamination, the Container 1376 <br />shall not be Collected. Instead, the driver will record the non-collection event in the 1377 <br />on-board computer system and shall affix a non-collection notice to the Container. 1378 <br />If a driver observes Hazardous Materials in an uncollected Container, the driver shall 1379 <br />record that observation in the on-board computer system and also inform the route 1380 <br />supervisor. The route supervisor shall investigate and initiate applicable action within 1381 <br />one (1) Business Day. 1382 <br />Whenever a Container at a Commercial or a Multi-Family Dwelling Complex 1383 <br />Customer is not Collected, Contractor shall contact the Customer on the scheduled 1384 <br />Collection Day by telephone to explain why the Container was not Collected. 1385 <br />Whenever a Container is not Collected because of excess Contamination, a customer 1386 <br />6.2.B. - Page 48
