Completion of other activities specified in the then-current Three-Year Public 3344 <br />Education Plan. 3345 <br />5. Other educational activities as may be requested by Agency. 3346 <br />C. Determination and Payment of Liquidated Damages. In accordance with the 3347 <br />requirements of Section 14.07, Contractor shall provide a report that identifies any 3348 <br />non-compliance with performance measures listed in Attachment J and include 3349 <br />calculation of the Liquidated Damages due. Contractor may include with its report a 3350 <br />written request to meet with Agency's Manager or his or her designee to discuss 3351 <br />Contractor’s evidence refuting the basis for assessing Liquidated Damages 3352 <br />pertaining to unacceptable employee behavior. In such cases, Contractor shall 3353 <br />include with its report evidence in writing and written testimony of its employees and 3354 <br />others relevant to the incident(s)/non-performance. Agency's Manager or his or her 3355 <br />designee will provide Contractor with a written explanation of his or her determination 3356 <br />on each incident(s)/non-performance. The decision of Agency's Manager or his or 3357 <br />her designee shall be final. 3358 <br />D. Account Summary. Provide the following account summary information in table 3359 <br />format: 3360 <br />1. Number of Customers in each Rate and Charge category. 3361 <br />2. Total number of Residential, Commercial, and Drop Box Customers subscribing 3362 <br />to Solid Waste, Targeted Recyclable Materials, and Organic Materials Collection 3363 <br />service listed separately by Service Sector and material type. 3364 <br />3. Percentage of Customers subscribing to Targeted Recyclable Materials 3365 <br />Collection service (listed separately for Multi-Family, Commercial, and Drop Box 3366 <br />Customers), which shall be equal to the total number of Targeted Recyclable 3367 <br />Materials Customers divided by the total number of Solid Waste Customers. 3368 <br />4. Percentage of Customers subscribing to Organic Materials Collection service 3369 <br />(listed separately for Multi-Family, Commercial, and Drop Box Customers), which 3370 <br />shall be equal to the total number of Organic Materials Customers divided by the 3371 <br />total number of Solid Waste Customers. 3372 <br />5. Weekly gallons or cubic yards of service provided to Residential, Commercial, 3373 <br />and Drop Box Customers subscribing to Solid Waste, Targeted Recyclable 3374 <br />Materials, and Organic Materials Collection service listed separately by Service 3375 <br />Sector and material type for one week. 3376 <br />E. Operational Data. Contractor shall submit the following: 3377 <br />1. A summary of Collection route operational data including: average number of 3378 <br />Customers and Containers serviced per route per Day for each Collection route; 3379 <br />average number of actual both on-route and off-route hours per Day by route 3380 <br />(distinguishing between Standard Collection Vehicle Routes and Special 3381 <br />Collection Vehicle Routes, if appropriate); 3382 <br />2. List of the one hundred (100) largest generators based on weekly Solid Waste 3383 <br />volumes (listed in descending order) within Agency for both Commercial and 3384 <br />Multi-Family Customers. This reporting shall include, at a minimum: the name 3385 <br />of the Customer; the name of the business; the address of the business; the 3386 <br />6.2.B. - Page 94
