REV: 03-16-18 MI ATTY/AGR/2018.054/RECOLOGY OF SAN MATEO Page 87 of 119 ARTICLE 10 3585 FRANCHISE FEE AND OTHER FEES 3586 10.01 GENERAL 3587 The fees described in this Article shall be treated as Other Pass-Through Costs for the 3588 purposes of determining the Revenue Requirement and shall be recoverable through the 3589 Agency-approved Rates and Charges that are collected from Customers. 3590 10.02 FRANCHISE FEE 3591 In consideration of the exclusive franchise granted to Contractor by this Agreement, and 3592 to reimburse Agency for costs incurred in administering this Agreement, Contractor shall 3593 pay to Agency a Franchise Fee specified in Attachment M. 3594 10.03 OTHER FEES 3595 Agency has adopted other fees, which are intended to recover the costs of services related 3596 to Solid W aste management, Recycling, and cleanliness of public streets and/or public 3597 litter and Recycling containers through inclusion in Rates. The other fees currently in 3598 effect, or which are expected to be in effect as of January 1, 2021 are listed in Attachment 3599 M. 3600 10.04 TIME AND METHOD OF PAYMENT 3601 On or before the twentieth (20th) Day of each month, Agency shall remit revenues received 3602 from Customers minus (i) the amount of the Franchise Fees due on Gross Revenues 3603 Billed during the immediate previous month, (ii) payments by Agency to SBWMA for 3604 deliveries to Shoreway, and (iii) other fees, including one-twelfth of any other fee 3605 established by Agency, unless Agency directs a different payment schedule for such other 3606 fees. Agency’s obligation to pay Contractor is expressly limited to those revenues 3607 received from Customers. 3608 Agency shall provide, concurrently with the remittance of payment, a statement showing 3609 the calculation of each fee, including the Gross Revenues Billed from Customers in each 3610 Service Sector for that month. Payments from Agency to Contractor shall be made by a 3611 method mutually acceptable to Agency and Contractor. 3612 10.05 ADJUSTMENTS TO FEES; ADDITIONAL FEES 3613 Agency may from time to time adjust the amount of the fees described in this Article and 3614 may establish other fees. Changes in the total amount of fees shall be reflected in an 3615 adjustment to Contractor's Compensation and Rates. 3616 3617 6.2.B. - Page 100
