Whenever maintenance or improvement work needs to be performed for the creek, the <br />Lathrop/Maple Parcel is required for staging and culvert access. The Lathrop/Elm <br />Parcel is too small to access the creek and accommodate the necessary personnel, <br />vehicles and equipment needed for normal maintenance or capital improvement work. <br />If the City were not able to use the Lathrop/Maple Parcel, the trucks, equipment and <br />work crews would have to utilize Lathrop Street and Maple Street for parking and <br />staging areas. Due to the nearby active railroad tracks, and the high traffic volume on <br />Maple Street, this would not only create unsafe conditions for the work crews, but would <br />also significantly and adversely affect vehicular, bicycle and pedestrian traffic flow in the <br />area. Any construction traffic control on those major streets could cause safety <br />hazards, given the proximity of the Caltrain railroad tracks, for motorists, bicyclists and <br />pedestrians. <br /> <br />Access to the creek from the Lathrop Street bridge, which passes over the creek, is <br />similarly infeasible and impracticable, given the bridge’s age and narrow width. The <br />bridge may not safely support the construction equipment needed to lower materials or <br />personnel into the creek; closing the bridge would also adversely impact traffic on Maple <br />Street and create the same congestion, delays and safety hazards mentioned above. <br /> <br />The entire Lathrop/Maple Parcel (excluding public right-of-way) is estimated to include <br />approximately 10,957 square feet of land area, which includes approximately 3,366 <br />square feet for the creek itself that splits the parcel. <br /> <br /> <br />ALTERNATIVES <br />The Successor Agency could not approve the transfer of the Lathrop/Maple property. <br />Without transferring the properties to the City, the City may lose a maintenance and <br />staging access point along the Redwood Creek Culvert. <br /> <br /> <br />FISCAL IMPACT <br />There are no direct costs tied to the transfer of the property from the Successor <br />Agency to the City. Though the Redevelopment Agency and later, the Successor <br />Agency, oversaw use or potential use of the aforementioned property, the City <br />assumed maintenance on the property and paid for utilities and insurance using <br />General Funds without billing the Successor Agency or its predecessor. Since that is <br />the case, the City will not incur additional costs beyond what it is currently paying but <br />will be formally responsible for providing maintenance to the property. The City has <br />general liability coverage for the Successor Agency, but the City may need to obtain <br />property insurance for the Lathrop/Maple Culvert Parcel. <br /> <br /> <br />6.1.D. - Page 3
