03/26/2018 <br />WHEREAS, SBWMA presented the Model Amended and Restated Franchise <br />Agreement to SBWMA's Board of Directors on June 22, 2017, and the Board took action <br />recommending that each Member Agency negotiate an Amended and Restated <br />Franchise Agreement using the Model Amended and Restated Franchise Agreement as <br />the basis for such negotiations; and <br />WHEREAS, City staff worked with Recology San Mateo County to ensure that the <br />Amended and Restated Franchise Agreement between the City and Recology San Mateo <br />County reflects specific requirements for recyclable materials, organic materials and solid <br />waste collection services in the City of Redwood City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY, CALIFORNIA, AS FOLLOWS: <br />1. The City Council hereby approves the Amended and Restated Franchise <br />Agreement between the City of Redwood City and Recology San Mateo County for <br />Recyclable Materials, Organic Materials and Solid Waste Collection Services ("Amended <br />and Restated Franchise Agreement") attached as Exhibit A hereto. <br />2. The City Manager is hereby authorized to execute the Amended and <br />Restated Franchise Agreement. <br />3. This project has been reviewed with respect to applicability of the California <br />Environmental Quality Act ("CEQA"). The project is exempt from CEQA requirements <br />under CEQA Guidelines Section 15301 because approval and execution of the Amended <br />and Restated Franchise Agreement involves the operation and licensing of existing <br />facilities and equipment, and does not involve an expansion of use. The Amended and <br />Restated Franchise Agreement would extend the existing agreement to provide the same <br />level of service for solid waste collection service as currently provided. The project is also <br />exempt under CEQA Guidelines Section 15061(b)(3) because it can be seen with <br />certainty that there is no possibility approval and execution of the Amended and Restated <br />Franchise Agreement would cause a significant effect on the environment.
