Information Accuracy and Loading <br />Consultant is not responsible for the accuracy of data Consultant acquires to be loaded into the <br />PropertyL/NKTm system. City understands that Consultant will make all commercially reasonable <br />attempts to reconcile the information in the PropertyL/NKT^' system with those certified assessed <br />value reports. City understands, however, and acknowledges that Consultant does not guarantee <br />(or warrant or promise) that information in the PropertyL/NKTm system will balance with the <br />certified assessed value reports generated by the Auditor\Controller's office. City agrees that <br />failure of the information in the PropertyL/NKTm system to balance with the certified assessed <br />value reports generated by the AuditoAController's office is not a breach of this Agreement. <br />City's Assistance <br />City is responsible for providing all equipment, facilities, connection services, and personnel <br />required for City and its authorized users to access the Software. City is solely responsible for the <br />configuration, use, and maintenance of any software or equipment that Consultant does not <br />provide to City. Any loss of availability caused by City's software or equipment is not Consultant's <br />responsibility. <br />City understands that the VPN and the Services may contain encryption software that is or may <br />be subject to U.S. export controls under the Export Administration Regulations. City will not export <br />the VPN or Services without obtaining the appropriate licenses from the U.S. Bureau of Export <br />Administration.
