5. ~ ð-~ City Staff is informed that Docktown Marina has allowed certain occupants of vessels to occupy their vessels for extended periods of time (47 vessels). Such use of the marina may not be allowed under the Grant, is not allowed under the Revocable Permit and may not be allowed under Article 20 of the Zoning Ordinance. The Zoning Ordinance provides in part that residential use may be allowed under Article 20 provided that a Use Permit is obtained from the Zoning Administrator. The proposed Revocable Permit provides the following changes: (1) the use of the Docktown Marina is revised to provide that 47 berths may be used for residential purposes (aka live-aboards). The approval of such use is, however, (a) subject to the approval by the State Lands Commission of an amendment to the Grant to authorize such use and (b) subject to the issuance of a Use Permit by the Zoning Administrator under Article 20 of the Zoning Ordinance [Page 1, first paragraph]; and (2) the legal description of the area covered by the Revocable Permit has been revised to rectify an error in the legal description and a Plot Map is attached to the legal description for the convenience of both the City and Docktown Marina [Exhibits 1 and 2]. Alternative This Council may determine that the proposed changes (or either one of them) are not appropriate. Fiscal Impact In the event that this Council approves the proposed amendments, the City will incur expenses (staff time) in connection with the application to the State Lands Commission for the amendment to the language of the Grant. Docktown Marina will be required to pay a fee in connection with its application for a Use Permit. The fee for the application for the Use Permit will cover some of the cost to process the application.
