<br />5. ~ ð-~ <br /> <br />City Staff is informed that Docktown Marina has allowed certain occupants of vessels to <br />occupy their vessels for extended periods of time (47 vessels). Such use of the marina may <br />not be allowed under the Grant, is not allowed under the Revocable Permit and may not be <br />allowed under Article 20 of the Zoning Ordinance. The Zoning Ordinance provides in part <br />that residential use may be allowed under Article 20 provided that a Use Permit is obtained <br />from the Zoning Administrator. <br /> <br />The proposed Revocable Permit provides the following changes: (1) the use of the <br />Docktown Marina is revised to provide that 47 berths may be used for residential purposes <br />(aka live-aboards). The approval of such use is, however, (a) subject to the approval by the <br />State Lands Commission of an amendment to the Grant to authorize such use and (b) <br />subject to the issuance of a Use Permit by the Zoning Administrator under Article 20 of the <br />Zoning Ordinance [Page 1, first paragraph]; and (2) the legal description of the area <br />covered by the Revocable Permit has been revised to rectify an error in the legal <br />description and a Plot Map is attached to the legal description for the convenience of both <br />the City and Docktown Marina [Exhibits 1 and 2]. <br /> <br />Alternative <br />This Council may determine that the proposed changes (or either one of them) are not <br />appropriate. <br /> <br />Fiscal Impact <br />In the event that this Council approves the proposed amendments, the City will incur <br />expenses (staff time) in connection with the application to the State Lands Commission for <br />the amendment to the language of the Grant. Docktown Marina will be required to pay a <br />fee in connection with its application for a Use Permit.
