Page 6 of 7 <br />ATTY/ORD/ORD.459/RC AMENDING ARTICLE 59 COMMERCIAL CANNABIS ALTERNATIVE <br />REV: 03-30-18 MI <br />limited to twenty-five percent (25%) of the total square footage of the <br />Delivery Center. <br />2. Delivery Centers where no walk-in traffic is allowed are permitted as <br />of right under the Zoning Ordinance. <br />3. A Cannabis Business Permit, as described in Municipal Code, <br />Chapter 32, Article V, Division 7 (Regulation of Cannabis <br />Businesses), shall be required for a Delivery Center, with or without <br />accessory retail. <br />C. Deliveries. Deliveries to any person located in Redwood City. Deliveries are <br />also subject to all applicable requirements under Municipal Code, Chapter 32, <br />Article V, Division 7 (Regulation of Cannabis Businesses), whether they originate <br />in Redwood City or from another location. <br />59.5 Minimum Distance Requirements <br />A. Minimum Distance of 1,000 Feet. Commercial cannabis activity shall not be <br />established within 1,000 feet of any of the following uses: <br />1. Schools as defined in Section 59.3 (Definitions). <br />2. Child care facility as defined in Article 2 (Definitions) excluding large and <br />small family child care homes. <br />3. Public Parks as defined in Section 59.3 (Definitions). <br />4. Youth Centers as defined in Section 59.3 (Definitions) <br />5. Libraries as defined in Section 59.3 (Definitions). <br />B. Measurement of Distance. The required minimum distance is measured <br />horizontally in a straight line from the property line of the protected use to the <br />property line of the lot containing the commercial cannabis activity. <br />C. Exception – 600 Feet. Commercial cannabis activity shall not be established <br />within 600 feet of any of the protected uses identified in subsections (A)(1)-(5) if <br />the commercial cannabis activity would be located on the opposite side of U.S. <br />Highway 101 from the protected uses. <br />59.56 Cultivation of Cannabis for Personal Use Prohibited. <br />A. Cannabis cultivation is a prohibited use in all zoning districts except as provided <br />in subsection B. <br /> <br />B. Notwithstanding the general prohibition in subsection A, Iindoor cultivation of <br />no more than six 6 living cannabis plants for personal use is permitted in all <br />zoning districts. No more than six 6 living cannabis plants may be possessed, <br />planted, cultivated, harvested, dried, or processed within a private residence at <br />any one time, including within an accessory structure to a private residence that <br />is fully enclosed and secure. The plants shall not be visible from a public place. <br />Persons engaging in indoor cultivation must comply with state and local laws, <br />including all applicable building, electrical fire, and water codes and regulations. <br /> <br />59. 67 Violation—Penalty. <br />7.B. - Page 50
