A felony conviction for drug trafficking with enhancements pursuant <br />to Section 11370.4 or 11379.8 of the Health and Safety Code. <br />f. Conviction for any controlled substance felony subsequent to <br />licensure shall be grounds for revocation of a cannabis business <br />permit or denial of a cannabis business permit renewal. <br />g. Conviction for cultivation or production of a controlled substance on <br />public or private lands pursuant to Section 12025 or 12025.1 of the <br />Fish and Game Code. <br />h. Conviction for unauthorized, unpermitted, or unlawful cannabis <br />activities in any city, county or city and county in the five years <br />immediately preceding the issuance of a cannabis business permit <br />or cannabis business permit renewal. <br />4. The applicant, owners, and managers have not been convicted, cited, <br />fined, or penalized by the State or any city, county, or city and county, <br />or enjoined by any court of law, in the five years immediately preceding <br />the application for a cannabis business permit or cannabis business <br />permit renewal, for any unauthorized, unpermitted, or unlawful cannabis <br />activities. <br />5. The applicant, owners, and managers have not been convicted, cited, <br />fined, or penalized by the State or any city, county, or city and county, <br />or enjoined by any court of law, in the five years immediately preceding <br />the application for a cannabis business permit or cannabis business <br />permit renewal, for cultivation or production of a controlled substance on <br />public or private lands. <br />6. Security Plan. The applicant has provided a Security Plan that meets <br />the minimum standards set forth in these regulations and any applicable <br />City Manager regulations. <br />C. A cannabis business permit shall not be issued or renewed where the Assistant <br />City Manager confirms that one or more of the criterion set forth in Section <br />32.161(B) have not been met. A cannabis business permit also shall not be issued <br />or renewed where the Assistant City Manager determines that the application <br />contains a material falsehood or misrepresentation and/or omission of information <br />required by these regulations, any applicable City Manager regulations, and/or the <br />approved application form. If the Assistant City Manager denies the cannabis <br />business permit or cannabis business permit renewal, he or she shall specify in <br />writing the reasons for the denial of the application or application for renewal, and <br />the decision shall become final unless the applicant seeks an appeal pursuant to <br />Section 32.164 of this Division. <br />D. Each cannabis business permit issued pursuant to this Division shall expire twelve <br />(12) months after the date that the Assistant City Manager or his or her designee <br />6.4.A. - Page 21
