2. With support from LIBRE partners, FOCC will assist 110 low-income, immigrant individuals and families who need help applying for or maintaining safety net benefits. 3. With client's permission refer to LIBRE partners cases that FOCC believes need legal advice for benefits or immigration. 4. Secure a half-time employee to help FOCC meet its LIBRE obligations. 5. Work with Nuestra Casa to host a Know Your Rights Clinic at FOCC, as needed. 6. Use the LIBRE PIKA data base to submit data monthly to the LIBRE Project Coordinator with the number of immigrants screened for benefits, the number applications assisted, and referrals to LIBRE partners for legal and other assistance. 7. Provide to the LIBRE Steering Committee a progress report by December 2017 and a final report by August 2018, as needed. 8. Keep records of referrals assisted or referrals to the Human Services Agency to apply for safety net benefits. B. LASSMC obligations: 1. Provide training for FOCC, as needed, to provide the outreach activities, provide the LIBRE materials, and attend the outreach events as needed and available. 2. Provide consultation for FOCC staff about organizing outreach activities and provide LIBRE materials. IV. INDEMNIFICATION AND INSURANCE The CITY will maintain general liability and other insurance appropriate for its activities under this MOU. LASSMC will maintain professional liability insurance that insures against professional errors and omissions that may be made in performing any services to be rendered in connection with this Agreement, in the minimum amount of one million dollars ($1,000,000) per claim and in the aggregate. Each of the City and LASSMC will indemnify, defend, and hold harmless the other and its directors, officers, employees, agents, and assigns, from and against all claims, liabilities, losses, damages, and expenses, including, without limitation, claims arising from death or personal injury, attorneys' fees, and taxes and insurance contributions for which it has responsibility plus penalties and interest, which may arise directly or indirectly from (i) any breach by a party of this MOU, (ii) any other act or omission by a party taken in fulfillment of its obligations pursuant to this Agreement, (iii) any claims by suppliers, or creditors, or by other persons in a relationship with a party, or (iv) any claims relating to tax, insurance contribution, workers' compensation or other law applicable to a party. A party will have no obligation to indemnify the other party to the extent the liability is caused by the other party's gross negligence or willful misconduct. V. OTHER GROUND RULES A. This MOU is legally binding on both LASSMC as the fiscal agent for LIBRE and the CITY. B. Limitation on Use of Funds. FOCC will use the funds provided under this MOU exclusively for the purposes set out in Section III.
