Section 8.5 dealing with the chairperson of the SBWMA has been revised: <br /> (a) With the Executive Director coming on board, all of the "executive duties" of <br /> the Chair have been eliminated; <br /> (b) The San Carlos City Manager has, by agreement of the Member Agencies, <br /> been the Chair of the SBTSA since 1982. It was felt this tradition was no <br /> longer needed and that the chair should be selected (annually) by the <br /> Board from the Members at large. <br /> 4. Section 8.7 - Finance Director. This has been a paid part-time contracted <br /> position because of the work involved. Reference to "without compensation" is being <br /> deleted, as it is not consistent with the way this position has actually been handled. <br /> 5. Section 8.10 - Executive Director, with a list of typical executive duties, is added. <br /> The above are the major changes. Other "cleanup language" changes are shown in the <br /> attached Exhibit A by strike outs and/or underline. None are substantive. <br /> Please note that under the SBWMA existing JPA Agreement, Section 10.8, it takes a <br /> 2/3rds vote of all of the Member Agencies to amend the JPA Agreement. The <br /> amendments to the JPA Agreement will not take effect until they have been approved by <br /> 2/3rds of the Members of the JPA. <br /> Action Taken by Other Members <br /> As of December 7, the West Bay Sanitary District and the City of Belmont voted not to <br /> approve the revised JPA agreement. The cities of Atherton, Foster City, Menlo Park, San <br /> Carlos, and San Mateo have approved the agreement. The County of San Mateo Board of <br /> Supervisors had this item on their December 6 agenda, but continued it to January. <br /> It is our understanding that West Bay and Belmont did not approve the agreement because <br /> it does not provide for the Board to be composed of elected officials. <br /> Alternative <br /> The City Council may reject the recommendation. However, as noted above, if 2/3rds of all <br /> Member Agencies vote to amend the JPA Agreement, the First Amended and Restated <br /> Joint Exercise of Powers Agreement will take effect. <br /> Fiscal Impact <br /> Approval of the First Amended and Restated Joint Exercise of Powers Agreement for <br /> South Bayside Waste Management Authority will have no direct fiscal impact on the City as <br /> all costs associated with the SBWMA are borne by the solid waste rate payers. As the <br /> First Amended and Restated Join Exercise of Powers Agreement contains the new position <br /> of Executive Director of the SBWMA, there will be a slight increase in the rates paid by the <br /> solid waste rate payers which is estimated to be approximately .18% or $.34 per year for <br /> an average solid waste customer. <br /> 3 <br />
