REG:yc:5/11/64-7 R E S O L U T I O N 0.0. RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT WITH PACIFIC GAS AND ELECTRIC COMPANY FOR UTILITY FACILITY RELOCATIONS WHEREAS, a dispute has arisen between the City of Redwood City and Pacific Gas and Electric Company concerning the effect of certain documents on Pacific Gas and Electric Company's franchise obligation to relocate its facilities within City streets at its own expense to accommodate a proper governmental use thereof; and WHEREAS, Pacific Gas and Electric Company has filed action No. 106359 in the Superior Court of the State of California in and for the County of San Mateo against the City of Redwood City, among others, for a determination of the legal rights and duties as between the City of Redwood City and Pacific Gas and Electric Company arising from said documents; and WHEREAS, it is deemed desirable and mutually beneficial by the City of Redwood City and Pacific Gas and Electric Company to resolve and compromise their differences by agreement and there has been submitted to this Council, for approval, an agreement for said purpose; and WHEREAS, this Council has reviewed the same and desires to signify its approval thereof and to authorize the execution thereof; NOW, THEREFORE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. That certain agreement between the City of Redwood City and Pacific Gas Electric Company, entitled "Agreement" (Form dated 5/11/64), a copy of which is presently on file in the office of the City Clerk and to which reference is made for full parti- culars, is hereby approved, and the City Manager is hereby author- ized and directed to execute the same for and on behalf of the City of Redwood City.
