Authority. <br />1. This Article shall be known and may be cited as the "Affordable Housing Ordinance." <br />2. The fees established pursuant to this Article are adopted under the authority of <br />California Constitution Article XI, Section 7, which provides: "A county or city may <br />make and enforce within its limits all local, police, sanitary, and other ordinances and <br />regulations not in conflict with general laws," and in accordance with the findings set <br />forth in the ordinance codified in this Article. <br />3. This Article shall apply to the extent permitted by the statutes and laws of the State <br />of California. <br />B. The purpose of this Article is to: <br />1. Increase the supply of affordable housing by imposing an inclusionary requirement for <br />residential development projects; and <br />2. Ensure that smaller -size developments continue to be encouraged as an important <br />component of the City's housing strategy; <br />3. Implement the Housing Element by creating a mechanism to provide affordable housing, <br />intended to meet the needs of all community members. <br />29.2 Definitions <br />1. "Affordable housing fund" means a fund or account designated by the City to maintain and <br />account for all monies received pursuant to this Article. <br />2. "Affordable ownership cost" means the sales price of a for -sale affordable unit resulting in <br />projected average monthly housing payments, during the first calendar year of a household's <br />ATTY/RESO.0032/PC RESO RECOMMENDING COUNCIL TO ADOPT ARTICLE 29 AFFORDABLE HOUSING <br />REV: 05-07-18 PR <br />Page 3 of 18 <br />
