purpose of the Planned Development Permit is to ensure the design and construction quality <br />contained in all aspects of the development exceed the quality standards typically required for <br />new developments located in similar zoning districts. The Project site is comprised of six parcels <br />that would be merged and resubdivided into six parcels, including five developable lots for 131 <br />condominium units with the recording of the final map, and the remaining parcel for the interior <br />roadway. Upon approval of the Tentative Map, the Project site would consist of six parcels for <br />131 condominium units, private roadways and common open space. Section 30.130 states: <br />“While condominium and community apartment projects present benefits in the <br />nature of increased amenities, opportunities for dwelling ownership and leisure <br />time, the special nature of such projects creates conditions that may result in <br />neglect, deterioration and lack of maintenance, causing negative impact upon the <br />health, safety, welfare and economic prosperity of the City and its citizens. <br />Because of the unique nature of the problems created by condominium and <br />community apartment projects, it is the express intent of the City to treat such <br />projects differently from other types of multi-family dwellings and to establish <br />rules and standards thereof, regulating the construction of, and conversion to, <br />condominium projects and community apartment projects in the City.” <br /> <br />In accordance with this purpose, the Final Map will include the condominium units and will be <br />reviewed for substantial conformance with the Tentative Map pursuant to all applicable <br />standards outlined in Chapter 30 of the Municipal Code. Conformance with these standards will <br />occur prior to City Council approval of the Final Map. In order to grant a Planned Development <br />Permit, the Planning Commission must make the findings, as required by Section 46.5 of the <br />Zoning Ordinance. <br />The finding for approval of the Planned Development Permit and Condominium Permit can be <br />made as the proposed development incorporates quality architectural design and exterior <br />materials that exceed the quality standards typically required for new developments. The <br />developer will also construct and maintain the Bay Trail and a new waterfront park for the <br />benefit of the community. <br /> <br />Tentative Map <br />The Project requires approval of a Tentative Map per Chapter 30, Article III of the Municipal <br />Code (Subdivision Ordinance). The Project site is comprised of six parcels that would be <br />merged and resubdivided into six parcels for 131 condominium units, internal roadways and <br />common open space. Subdivision Ordinance Section 30.42 requires the hearing authority to <br />disapprove a Tentative Map if any of the findings can be made. The findings to approve the map <br />can be made as the subdivision is consistent with the General Plan, the site is physically suited <br />for the density of development, the proposed improvements are not likely to cause substantial <br />environmental damage and the subdivision will not conflict with public easements. <br />6.4.B. - Page 131
