ATTY/ORD/2018/ORD.469/ADOPTING ARTICLE 29 & AMENDING SECTION 32.19 <br />REV: 05-15-18 PR <br />Page 1 of 28 <br />ORDINANCE NO. ___ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY ADOPTING ARTICLE 29 (REQUIREMENTS <br />FOR AFFORDABLE HOUSING) AND AMENDING SECTION 32.19 <br />(AFFORDABLE HOUSING DENSITY BONUSES) <br /> <br />WHEREAS, on October 24, 2014, the City Council of the City of Redwood <br />City adopted its 2015-2023 Housing Element which contemplates, among other <br />things, an ordinance to provide a mechanism to increase the supply of affordable <br />housing in the City pursuant to Housing Element Programs H-3 and H-14; and <br />WHEREAS, in September of 2017, Governor Brown signed AB 1505 <br />allowing cities and counties to require on-site construction of affordable housing <br />(also called “inclusionary” housing) in connection with the development of market- <br />rate rental residential projects; and <br />WHEREAS, on December 18, 2017, the City Council of the City of <br />Redwood City initiated proceedings to consider a new requirement for on-site <br />construction of affordable housing; and <br />WHEREAS, the proposed Zoning Ordinance Amendment (the “Zoning <br />Amendment”) would move existing Article 29 (CO (Commercial Office) District) to <br />Article 12 (Reserved) and create a new Article 29 (Requirements for Affordable <br />Units) instituting a requirement for residential development over a certain size to <br />provide affordable units as part of the project, incorporate Municipal Code Chapter <br />18 Article XVII (Affordable Housing Impact Fee) into Article 29, and repeal and <br />replace Section 32.19 (Affordable Housing Density Bonuses) to comply with state <br />law; and <br />WHEREAS, on May 1, 2018, the Planning Commission held a duly-noticed <br />public hearing on the Zoning Amendment; and <br />WHERAS , Municipal Code Article XVII (Affordable Housing Impact Fee) of <br />Chapter 18 (Local Improvements and Planning) will be repealed (the “Municipal <br />Code Amendment”) and all provisions incorporated into the new Article 29 of the <br />Zoning Ordinance; and <br />WHEREAS, on May 21, 2018, the City Council held a duly-noticed public <br />hearing on the Zoning Amendment and the Municipal Code Amendment <br />7.A. - Page 16
