Authority. 1. This Article shall be known and may be cited as the "Affordable Housing Ordinance." 2. The fees established pursuant to this Article are adopted under the authority of California Constitution Article XI, Section 7, which provides: "A county or city may make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws," and in accordance with the findings set forth in the ordinance codified in this Article. 3. This Article shall apply to the extent permitted by the statutes and laws of the State of California. B. The purpose of this Article is to: 1. Increase the supply of affordable housing by imposing an inclusionary requirement for residential development projects; and 2. Ensure that smaller-size developments continue to be encouraged as an important component of the City’s housing strategy; 3. Implement the Housing Element by creating a mechanism to provide affordable housing, intended to meet the needs of all community members. 29.2 Definitions 1. "Affordable housing fund" means a fund or account designated by the City to maintain and account for all monies received pursuant to this Article. 2.
