Equipment/Storage: All trash enclosures shall be completely screened <br />and covered from off-site view by a solid fence or masonry wall at least <br />six feet high and in harmony with the architecture of the building(s). <br />Alternatively, the trash facilities may be placed within the building. <br />Sewer drains, fire sprinklers, enclosures, and roofing (if outdoors) shall be <br />provided as per City standards. <br />e. Implementation and Reporting: Applicant and its successors and <br />assigns shall implement the approved Discards Collection Plan and report <br />its activities and achievements to the Public Works Department annually <br />as requested. <br />28. Agreements - Prior to Building Permit Issuance, enter into the following <br />agreements in a form acceptable to the City Attorney and the Community <br />Development Director: [COA][ENGINEERING] <br /> <br />a. Landscape Maintenance Agreement for all assigned landscape areas <br />in public rights of way, easements, and/or on property in which the City <br />holds an interest to be maintained. Maintenance items shall include, but <br />are not limited to, planting trees, shrubs, flowers, grass and all <br />appurtenances including irrigation systems and pedestrian scale lighting. <br /> <br />b. Stormwater Treatment Measures Maintenance Agreement for all on- <br />site stormwater treatment measures associated with the project. <br /> <br />c. Improvement Agreement to guarantee the installation of all <br />improvements required of the project and to provide for payment of all City <br />inspection and plan check charges associated with the installation of <br />public and private improvements, including, but not limited to, streets, <br />sanitary sewers, water, storm drains and street lights. <br /> <br />d. Parking Agreement – Provide an agreement between the subject owner <br />and with the owner of the adjacent parcel dedicating three (3) parking <br />spaces for Trail Public Parking in accordance with the NMPP. <br /> <br />e. Dedication and Vacation of Easements – Provide the necessary <br />documentation for the dedication of public access, emergency vehicle <br />access, and public utility easements, and for the abandonment of <br />relocated easements as needed to facilitate the new public improvements. <br /> <br />f. Affordable Housing Agreement with the City restricting the rental of <br />nineteen (19) units, comprised of: <br />i. one (1) studio unit, three (3) one-bedroom units, and three (3) two- <br />7.B. - Page 36
