B. Period of availabilitv of funds: Pursuant to CFR, Title 2 as applicable, Contractor <br />may only charge to this Agreement costs resulting from obligations incurred during the <br />funding period of the federal and state awards for the term specified in this Sub Recipient <br />Agreement, unless carryover of these balance is specifically identified in payment section <br />of this Agreement. All obligations incurred under this Agreement must be liquidated no <br />later than ninety (90) days after the end of the funding period, pursuant to federal law. <br />C. Matching or cost sharing: Pursuant to CFR, Title 2 as applicable, matching or cost <br />sharing requirement applicable to the federal program must be satisfied by disbursements <br />for allowable costs or third -party in-kind contributions and must be clearly identified and <br />used in accordance with all applicable federal, state and local laws. <br />D. Proqram income: Program income must be used and accounted for as specified <br />in CFR, Title 2. <br />E. Real Propertv: If Contractor is authorized to use funds pursuant to this Agreement <br />for the acquisition of real property, title, use, and disposition of the real property will be <br />governed by the provisions of CFR, Title 2. <br />F. Equipment: Title, use, management (including record keeping, internal control, <br />and maintenance) and disposition of equipment acquired by Contractor or its sub- <br />contractors/grantees with federal funding awarded under this Agreement will be governed <br />by the provisions of CFR, Title 2, as applicable. <br />G. Supplies: Title and disposition of supplies acquired by Contractor or its sub- <br />contractor with federal funding pursuant to this Agreement will be governed by the <br />provisions of CFR, Title 2, as applicable. <br />13. Non -Discrimination and Other Requlrements <br />Contractor shall comply with all applicable anti -discrimination federal, state and <br />local law, including the laws referenced in the Contractor Certification Clauses <br />(CCC 307) which are hereby incorporated by reference. In addition, Contractor <br />shall comply with the following: <br />Eaual Access to Federaliv Funded Benefits. Programs and Activities <br />Contractor shall ensure compliance with Title VI of the Civil Rights Acts of 1964 [42 <br />USC § 2000d; 45 CFR Part 80], which prohibits recipients of federal financial <br />assistance from discrimination against persons based on race, color, religion, or <br />national origin. <br />Equal Access to State -Funded Benefits, Proqrams and Activities <br />Contractor shall, unless exempted, ensure compliance with the requirement of Cal. <br />Gov. Code §§ 11135 to 11139.5; 22 CCR § 98000, of seq., which prohibit recipients <br />of state financial assistance from discriminating against persons based on race, <br />10 <br />REV: 01-17-18 RL <br />
