<br />permits associated with such equipment and/or systems and provide Landlord <br /> <br />with copies of same <br /> <br />4.3.7 Removal. Notwithstanding anything to the contrary in this <br /> <br />lease, Tenant shall remove all freon and freon-containing equipment and/or <br />systems installed in the Premises by or on behalf of Tenant prior to the Expiration <br /> <br />Date of this lease. Prior to the removal of any such freon or freon-containing <br /> <br />equipment and/or systems, Tenant shall submit to Landlord for Landlord's <br />approval, the names of Tenant's contractors and all plans and specifications for <br /> <br />such removal. Tenant and Tenant's contractors shall comply with all legal <br />requirements, industry practices and rules established by Landlord in performing <br /> <br />such removal work. Tenant shall repair any damage to the Building or Building <br />Systems and Equipment associated with such removal, and Tenant shall be <br /> <br />responsible for the costs associated with restoring the Building to the condition <br />which existed immediately prior to any modification undertaken by Landlord in <br /> <br />order to accommodate Tenant's freon-containing equipment and/or systems. <br /> <br />4.3.8 Hazardous Materials Representation and Warranty. <br />Landlord warrants and represents that, to the best of Landlord's actual <br /> <br />knowledge, no part of the Premises, Building, or common area of the Property <br />contains asbestos-containing construction materials ("ACM") or other Hazardous <br /> <br />Materials at detectable levels prohibited by any applicable Laws. During the <br />Term of this Lease, if Tenant's testing or examination indicates the presence of <br /> <br />ACM or other Hazardous Materials in the Premises, Building, or common areas <br />of the Property, landlord agrees to remove and/or abate the same, and to <br /> <br />restore the Premises, Building, or common areas of the Property to their prior <br />condition, at Landlord's sole cost and expense (unless the ACM or Hazardous <br /> <br />Material to be removed or abated has been introduced onto the Property by <br /> <br />~ <br />~ <br />
