?/~- / REPORT To the Honorable Mayor and City Council From the City Manager January 9, 2006 Subject Redwood Shores Lagoon - Aquatic Plant Management and Environmental Engineering Services Recommendation By Motion, authorize the City Manager to execute Amendment No.1 to the Agreement with Waterworks Industries, Inc., Windsor, California for the not-to-exceed amount of $198,782.50 to continue professional aquatic plant management and environmental engineering services for the Redwood Shores Lagoon for one year to December 31 , 2006. Background In January 2004, City Council awarded a two year contract, January 2004 through December 31, 2005, to Waterworks Industries for the not-to-exceed amount of $397,566 for lagoon maintenance services. Waterworks Industries was selected as the City contractor for these services following a competitive process. The firm's performance over the two-year contract period has demonstrated a strong knowledge of the Redwood Shores Lagoon system, an understanding of the objectives of the City's lagoon management plan, and sensitivity to the beneficial use and aesthetic value that the lagoon provides to City residents. The original Agreement contains a provision that allows the City Manager to amend the Agreement for three consecutive one- year periods, at its sole discretion, based on the City's needs, contractor performance, and appropriation of funds by the City Council. However, since Waterworks Industries has requested a change to the contract fee schedule, Council approval is required. The proposed Amendment to the Agreement will (1) extend the term of the Agreement for one year to December 31,2006, (2) continue the scope of services, and (3) incorporate a revised fee schedule that reflects fees and charges for 2006. Staff is recommending approval of the amendment increasing the total contract value by $198,782.50.00 from $397,565.00 to $596,347.50. The original two-year Agreement not-to-exceed contract value of $397,566.00 constituted an annual expenditure of $198,782.50. The proposed Amendment continues the services at the same value for one year but allows of an update to 2006 fees and charges, Exhibit B-1, Fee Schedule. The adjusted fee schedule is based on increased fuel and freight costs as reflected in the cost increase for the algaecide, EarthTec and personnel salary adjustments and increases. Alternatives There is no reasonable alternative to a contractual agreement for these services. The equipment and expertise required to perform these services is highly specialized and not available through in-house staffing. The City Council could decide to forego lagoon maintenance services. However, the City would not be able to comply with the Clean Water Act and the mandated regulatory requirements associated with the municipal NPDES without this type of ongoing maintenance service. The City would be subjected to fines for non-compliance with these mandates and would jeopardize the water quality of
