Recommendation Approve a Resolution adopting a Right-of-Way Use Agreement with NextG Networks to install and maintain micro-cellular optical repeater equipment on City-owned facilities. Background NextG Networks, a Delaware corporation based in San Jose, owns and operates a fiber- based wireless telecommunications network for the purpose of improving coverage and capacity for wireless service providers (NextG's customers), utilizing small, less-obtrusive, low-power equipment instead of traditional cell towers and rooftop antennas. NextG installs its equipment in the public right-of-way on city-owned streetlight poles, lighting fixtures, or utility poles, in order to provide its service, and is requesting a right-of-way agreement with Redwood City for this purpose. The equipment to be installed consists of an antenna on top of a street light pole, and one of several sizes of small cabinets and a meter box attached to the side of the pole. The antenna and cabinet sizes vary depending on the technical needs at a given location. The types of equipment are shown in Exhibit A to the draft agreement. NextG has indicated that they would install a maximum of five or six units per square mile, and have initially identified two areas within Redwood City where they expect to focus their efforts: 1. Bordering EI Camino Real 2. Portions of Farm Hill/Emerald Hills NextG has been approved by the Federal Communications Commission (FCC) as a telecommunications carrier under the 1996 Telecom Act, and is a telephone company under section 7901 of California State Statutes holding a Certificate of Public Convenience and Necessity (CPNC) from the California Public Utilities Commission. As such, the City cannot deny NextG the ability to operate as a telecommunications carrier in the City. However, the City can control the manner in which NextG utilizes the City's public rights-of-way and require them to provide compensation to the City for any equipment they install within the City.
