<br />FXS:(1."~ 11/20/96 <br /> <br />(009/72) <br /> <br />City <br /> <br />shall <br /> <br />grant <br /> <br />reasonable <br /> <br />extensions <br /> <br />of <br /> <br />time <br /> <br />for <br /> <br />the <br /> <br />performance <br /> <br />of <br /> <br />such <br /> <br />services <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />General <br /> <br />Conditions. <br /> <br />CM/GC acknowledges the importance of Cityls Project schedule <br /> <br />and agrees to put forth its best professional efforts to perform <br /> <br />its <br /> <br />services <br /> <br />under <br /> <br />this <br /> <br />Agreement <br /> <br />and <br /> <br />cause <br /> <br />the <br /> <br />services <br /> <br />of <br /> <br />others to be performed in a manner consistent with the schedule <br /> <br />referenced in Exhibits "A" and "E", as amended from time to time. <br /> <br />City <br /> <br />understands, <br /> <br />however, <br /> <br />that <br /> <br />CM/GCls <br /> <br />performance <br /> <br />must <br /> <br />be <br /> <br />governed by sound construction management practices. <br /> <br />15. <br /> <br />LIQUIDATED DAMAGES. <br /> <br />It is hereby agreed by the parties <br /> <br />to this Agreement that in case all work called for under this <br /> <br />Agreement is not finished or completed on or before the time set <br /> <br />forth in this Agreement, damage will be sustained by City, <br /> <br />and <br /> <br />that it is and will be impracticable and extremely difficult to <br /> <br />ascertain and determine the actual damage which the City will <br /> <br />sustain <br /> <br />ln <br /> <br />the <br /> <br />event <br /> <br />of <br /> <br />and by <br /> <br />reason of <br /> <br />such delay; <br /> <br />it <br /> <br />is <br /> <br />therefore agreed CM/GC will pay to City the sum calculated at the <br /> <br />rate of Seven Hundred Fifty and No/I00 Dollars ($750.00) per day <br /> <br />as liquidated damages for each and every calendar dayls unexcused <br /> <br />delay in substantially completing the construction of the Fire <br /> <br />Station <br /> <br />and <br /> <br />Maintenance <br /> <br />Facility <br /> <br />within <br /> <br />the <br /> <br />time <br /> <br />prescribed. <br /> <br />CM/GC shall have One Hundred Seventy-five <br /> <br />(175) <br /> <br />work days from <br /> <br />the date of the Fire Station Notice to Proceed with Construction <br /> <br />to <br /> <br />complete <br /> <br />substantially <br /> <br />the <br /> <br />Pire <br /> <br />Station <br /> <br />and <br /> <br />One <br /> <br />Hundred <br /> <br />Seventy-five <br /> <br />(l75) <br /> <br />work days <br /> <br />from the date of the Maintenance <br /> <br />Facility <br /> <br />Notice <br /> <br />to <br /> <br />Proceed <br /> <br />to <br /> <br />complete <br /> <br />substantially <br /> <br />the <br /> <br />Maintenance Facility, plus such additional days as are authorized <br />10 <br />
