<br />FXS:dj¥" 05/l6/97 <br /> <br />(009/72) <br /> <br />ORIGINAL <br /> <br />--------- <br /> <br />AM END E D <br />A G R E E MEN T <br /> <br />PROFESSIONAL CONSTRUCTION MANAGEMENT <br />AND GENERAL CONTRACTOR SERVICES <br />FIRE STATION AND MAINTENANCE FACILITY <br /> <br />THIS <br /> <br />AGREEMENT, <br /> <br />made <br /> <br />and entered <br /> <br />into this <br /> <br /># h~ <br />'J., day of <br /> <br />(j t~ \,v-J' <br /> <br />1997, <br /> <br />by <br /> <br />and <br /> <br />between <br /> <br />the <br /> <br />CITY <br /> <br />OF <br /> <br />REDWOOD <br /> <br />CITY, <br /> <br />a <br /> <br />municipal <br /> <br />corporation <br /> <br />of <br /> <br />the <br /> <br />State <br /> <br />of <br /> <br />California, <br /> <br />("City"), and RUDOLPH & SLETTEN, INC. of Poster City, California, <br /> <br />the CONSTRUCTION MANAGER/GENERAL CONTRACTOR ("CM/GC"); <br /> <br />WIT N E SSE T H : <br /> <br />WHEREAS, on November 25, 1996, the City Council of the City <br /> <br />of Redwood City approved an agreement between City and CM/GC for <br /> <br />professional <br /> <br />construction <br /> <br />management <br /> <br />and <br /> <br />general <br /> <br />contractor <br /> <br />services for the construction of the new fire station No. 20 (the <br /> <br />"Fire <br /> <br />Station" ) <br /> <br />and <br /> <br />a <br /> <br />maintenance <br /> <br />facility <br /> <br />(the <br /> <br />"Maintenance <br /> <br />Facility") in the City of Redwood City (the "Project"); and <br /> <br />WHEREAS, City and CM/GC desire to modify said agreement to <br /> <br />set <br /> <br />forth <br /> <br />the <br /> <br />Final <br /> <br />Agreed <br /> <br />Price <br /> <br />and <br /> <br />amend <br /> <br />the <br /> <br />Project's <br /> <br />schedule; and <br /> <br />WHEREAS, <br /> <br />in connection with the Project, the City requires <br /> <br />professional <br /> <br />construction <br /> <br />management <br /> <br />and <br /> <br />general <br /> <br />contractor <br /> <br />services; and <br /> <br />WHEREAS, CM/GC represents that it possesses the experience, <br /> <br />and <br /> <br />is <br /> <br />qualified, <br /> <br />to <br /> <br />perform <br /> <br />the <br /> <br />aforesaid <br /> <br />services <br /> <br />for <br /> <br />the <br /> <br />Project; <br /> <br />NOW, THEREFORE, the parties agree as follows: <br /> <br />1. <br /> <br />CM/GCIS <br /> <br />SERVICES. <br /> <br />CM/GC <br /> <br />shall <br /> <br />perform <br /> <br />construction <br /> <br />."- ...--.......-..-...-......,---.--..,----......-.......-..----- <br />
