<br />FXS:d;1- 05/l6/97 <br /> <br />(009/72) <br /> <br />finally rendered, prepared by CM/GC pursuant to the terms of this <br /> <br />Agreement, <br /> <br />shall, upon preparation and delivery to City, become <br /> <br />the <br /> <br />property <br /> <br />of <br /> <br />City. <br /> <br />All <br /> <br />Subcontracts <br /> <br />between <br /> <br />CM/GC <br /> <br />and <br /> <br />subcontractors shall be approved as to form by City prior to the <br /> <br />Invitation for Bids. <br /> <br />14. <br /> <br />SCHEDULE. <br /> <br />CM/GC shall generally adhere to the schedule <br /> <br />referenced <br /> <br />in Exhibit <br /> <br />"A" <br /> <br />and more <br /> <br />specifically <br /> <br />set <br /> <br />forth <br /> <br />in <br /> <br />Exhibit <br /> <br />"E", <br /> <br />incorporated herein by <br /> <br />reference, <br /> <br />provided, <br /> <br />that <br /> <br />City <br /> <br />shall <br /> <br />grant <br /> <br />reasonable <br /> <br />extensions <br /> <br />of <br /> <br />time <br /> <br />for <br /> <br />the <br /> <br />performance <br /> <br />of <br /> <br />such <br /> <br />services <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />General <br /> <br />Conditions. <br /> <br />CM/GC acknowledges the importance of City's Project schedule <br /> <br />and agrees to put forth its best professional efforts to perform <br /> <br />its <br /> <br />services <br /> <br />under <br /> <br />this <br /> <br />Agreement <br /> <br />and <br /> <br />cause <br /> <br />the <br /> <br />services <br /> <br />of <br /> <br />others to be performed in a manner consistent with the schedule <br /> <br />referencêd in Exhibits "A" and "E", as amended from time to time. <br /> <br />City <br /> <br />understands, <br /> <br />however, <br /> <br />that <br /> <br />CM/GC's <br /> <br />performance <br /> <br />must <br /> <br />be <br /> <br />governed by sound construction management practices. <br /> <br />15. <br /> <br />LIQUIDATED DAMAGES. <br /> <br />It is hereby agreed by the parties <br /> <br />to this Agreement that in case all work called for under this <br /> <br />Agreement is not finished or completed on or before the time set <br /> <br />forth in this Agreement, damage will be sustained by City, <br /> <br />and <br /> <br />that it is and will be impracticable and extremely difficult to <br /> <br />ascertain and determine the actual damage which the City will <br /> <br />sustain <br /> <br />in <br /> <br />the <br /> <br />event of <br /> <br />and by <br /> <br />reason <br /> <br />of <br /> <br />such delay; <br /> <br />it <br /> <br />is <br /> <br />therefore agreed CM/GC will pay to City the sum calculated at the <br /> <br />rate of Seven Hundred Fifty and No/I00 Dollars ($750.00) per day <br /> <br />10 <br />
