<br />FXS:d;'- 05/l6/97 <br /> <br />(009/72) <br /> <br />respect to specific warranties contained in the trade services of <br /> <br />the <br /> <br />Specifications <br /> <br />by <br /> <br />the <br /> <br />Project <br /> <br />Architect, <br /> <br />to <br /> <br />cause <br /> <br />to <br /> <br />be <br /> <br />repaired or replaced any part of the \vork performed hereunder <br /> <br />which constitutes a defect resulting from the use of inferior or <br /> <br />defective materials, equipment or workmanship. <br /> <br />The Fire Station <br /> <br />and the Maintenance Facility shall be subject to separate Notices <br /> <br />of Completion and acceptances by City's City Council. <br /> <br />If, within <br /> <br />said period, <br /> <br />any repairs or replacements in connection with the <br /> <br />work are, in the opinion of the City Engineer, rendered necessary <br /> <br />as <br /> <br />a <br /> <br />result <br /> <br />of <br /> <br />the <br /> <br />use <br /> <br />of <br /> <br />inferior <br /> <br />or <br /> <br />defective <br /> <br />materials, <br /> <br />equipment or workmanship, <br /> <br />CM/GC agrees, <br /> <br />upon receipt of notice <br /> <br />from City, <br /> <br />and without expense to City to promptly cause to be <br /> <br />repaired or replaced such material or workmanship and/or correct <br /> <br />any and all defects therein. <br /> <br />If CM/GC, after such notice, fails <br /> <br />to proceed promptly to comply with the terms of this guarantee, <br /> <br />City may perform the work necessary to effectuate such correction <br /> <br />and recover the cost thereof from CM/GC or his/her sureties. <br /> <br />Any and all other special guarantees which may be applicable <br /> <br />to <br /> <br />definite <br /> <br />parts <br /> <br />of <br /> <br />the <br /> <br />work <br /> <br />under <br /> <br />this <br /> <br />Agreement <br /> <br />shall <br /> <br />be <br /> <br />cons idered as <br /> <br />an additional guarantee <br /> <br />and <br /> <br />shall not reduce or <br /> <br />limit <br /> <br />the <br /> <br />guarantee <br /> <br />as <br /> <br />provided <br /> <br />by <br /> <br />CM/GC <br /> <br />pursuant <br /> <br />to <br /> <br />this <br /> <br />paragraph during the first year of the life of such guarantee. <br /> <br />20. <br /> <br />INSURANCE. <br /> <br />CM/GC shall acquire and maintain Workers I <br /> <br />Compensation, employer's liability, commercial general liability, <br /> <br />owned, <br /> <br />non-owned and hired automobile <br /> <br />liability, <br /> <br />and builder IS <br /> <br />risk <br /> <br />insurance <br /> <br />coverage <br /> <br />relating <br /> <br />to <br /> <br />CM/GCls <br /> <br />services <br /> <br />to <br /> <br />be <br /> <br />performed hereunder covering Cityls risks in form subject to the <br /> <br />15 <br />
