<br />FXS:dj'.05/16/97 <br /> <br />(009/72) <br /> <br />such policy <br /> <br />be <br /> <br />cancelled before <br /> <br />final <br /> <br />completion of <br /> <br />the work <br /> <br />herein contemplated, and should CM/GC fail to immediately procure <br /> <br />other insurance as herein required, <br /> <br />then City may procure such <br /> <br />insurance and deduct the cost thereof from the amount due the <br /> <br />CM/GC. <br /> <br />21. <br /> <br />COMPLIANCE WITH LABOR LAWS. <br /> <br />(a) CM/GC shall comply and <br /> <br />shall cause compliance with all applicable provisions of Section <br /> <br />1810 to l815, inclusive, of the California Labor Code relating to <br /> <br />working hours. <br /> <br />CM/GC shall, as a penalty to City, forfeit Twenty <br /> <br />Five and No/100 Dollars ($25.00) <br /> <br />for each worker employed in the <br /> <br />execution of this Agreement by CM/GC or by any Subcontractor for <br /> <br />each <br /> <br />calendar <br /> <br />day <br /> <br />during <br /> <br />which <br /> <br />such <br /> <br />worker <br /> <br />is <br /> <br />required <br /> <br />or <br /> <br />permitted to work more than eight (B) hours in anyone calendar <br /> <br />day and forth <br /> <br />(40) <br /> <br />hours in anyone calendar week, unless such <br /> <br />worker receives compensation for all hours worked in excess of <br /> <br />eight <br /> <br />(8 ) <br /> <br />hours at not less than l-l/2 times the basic rate of <br /> <br />pay. <br /> <br />(b) <br /> <br />Pursuant to the provisions of California Labor Code, <br /> <br />Section l770 et seq., CM/GC and any Subcontractor under him/her <br /> <br />shall pay not less than the prevailing rate of per diem wages as <br /> <br />determined <br /> <br />by <br /> <br />the <br /> <br />Director <br /> <br />of <br /> <br />the <br /> <br />California <br /> <br />Department <br /> <br />of <br /> <br />Industrial Relations. <br /> <br />Pursuant to the provisions of California <br /> <br />Labor Code Section 1773.2, CM/GC is hereby advised that copies of <br /> <br />the prevailing rate of per diem wages and a general prevailing <br /> <br />rate for holidays, <br /> <br />Saturdays and Sundays, <br /> <br />and overtime work in <br /> <br />the locality in which the work is to be performed for each craft, <br /> <br />classification, <br /> <br />or <br /> <br />type <br /> <br />of <br /> <br />worker <br /> <br />required <br /> <br />to <br /> <br />execute <br /> <br />this <br /> <br />18 <br />
