the Council's rendering of any decision <br />Street Project entitlements, including <br />Downtown Precise Plan Amendment to <br />06/11/2018 <br />regarding the approval of the 851 Main <br />a General Plan Amendment and a <br />increase the development caps for new <br />office floor area in Downtown. <br />d. The Final SEIR reflects the City's independent judgment and has been found by <br />the City to be adequate to support the City's approval of the 851 Main Street <br />Project entitlements. <br />e. The information added in the Final SEIR does not constitute new significant <br />information requiring recirculation. <br />f. Based on the City's review of the Final SEIR, it has been determined that the <br />proposed 851 Main Street Project may have significant effects on the <br />environment, but that all identified significant effects can be mitigated to a less - <br />than -significant level. All significant and unavoidable impacts identified in the <br />Downtown Precise Plan EIR remain, but the benefits of implementation of the <br />Downtown Precise Plan and the Project outweigh those impacts as described in <br />the Findings and Statements required by the California Environmental Quality <br />Act and Statement of Overriding Considerations described in section (g) below. <br />g. Pursuant to Section 15091 of the CEQA Guidelines, the City's actions with <br />respect to the 851 Main Street Project shall be based upon and subject to the <br />findings, conclusions, mitigation measures and statements set forth in the <br />Findings and Statements Required by the California Environmental Quality Act <br />and Statement of Overriding Considerations dated June 11, 2018 and the <br />Mitigation Monitoring and Reporting Program for the 851 Main Street Project <br />(attached hereto as Exhibit A and Exhibit B and incorporated herein by <br />reference). <br />h. Specific economic, legal, social, technological, or other benefits outweigh the <br />unavoidable adverse environmental effects identified in the Final EIR for the <br />Downtown Precise Plan and the Final SEIR. <br />i. Pursuant to Section 15091 of the CEQA Guidelines, the City Council hereby <br />determines that any subsequent actions or approvals to implement the 851 Main <br />Street Project shall be based upon and subject to the findings, conclusions, <br />mitigation measures and statements set forth in the Findings and Statements <br />Required by the California Environmental Quality Act and Statement of <br />Overriding Considerations dated June 11, 2018 and attached hereto as Exhibit <br />A. <br />Section 4.
