4532 14.10 ASSURANCE OF PERFORMANCE <br />4533 If Contractor (i) persistently suffers the imposition of Liquidated Damages under Section <br />4534 14.07; (ii) is the subject of any labor unrest including work stoppage or slowdown, <br />4535 sickout, picketing, or other concerted job action; (iii) appears in the reasonable judgment <br />4536 of Agency to be unable to regularly pay its bills as they become due; (iv) is the subject of <br />4537 a civil or criminal proceeding brought by a federal, State, regional, or local agency for <br />4538 violation of an Environmental Law in the performance of this Agreement, or (v) performs <br />4539 in a manner that causes Agency to be uncertain about Contractor's ability and intention <br />4540 to comply with this Agreement, Agency may, at its option and in addition to all other <br />4541 remedies it may have, demand from Contractor reasonable assurances of timely and <br />4542 proper performance of this Agreement, in such form and substance as Agency may <br />4543 require. <br />4544 <br />REV: 03-16-18 MI <br />Page 112 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
