464 Owner
<br />465 "Owner" means the Person holding legal title to the real property constituting the Premises to
<br />466 which Solid Waste, Targeted Recyclable Materials, and/or Organic Materials Collection service
<br />467 is provided.
<br />468 Party(ies)
<br />469 "Party(ies)" refers to the Agency and Contractor, individually or together.
<br />470 Pass -Through Cost
<br />471 "Pass -Through Cost" means a cost to which no element of overhead, administrative expense, or
<br />472 profit, is added, such that the specific amount of such cost is included without modification in the
<br />473 calculations or reports prepared in implementing this Agreement.
<br />474 Person
<br />475 "Person" means any individual, firm, company, association, organization, partnership,
<br />476 corporation, trust, joint venture, the United States, the State, the County, towns, cities, or special
<br />477 purpose districts.
<br />478 Plant Materials
<br />479 "Plant Materials" means a subset of Organic Materials consisting of grass cuttings, weeds,
<br />480 leaves, prunings, branches, dead plants, brush, tree trimmings, dead trees (not more than six
<br />481 (6) inches in diameter) and five (5) feet in length, and similar materials generated at Premises,
<br />482 separated and set out for Collection. Plant Materials does not include materials not normally
<br />483 produced from gardens or landscape areas, such as, brick, rock, gravel, large quantities of dirt,
<br />484 concrete, sod, non-organic wastes, oil, and painted or treated wood products. Diseased plants
<br />485 and trees may be excluded from Plant Materials upon mutual consent of Agency and
<br />486 Contractor.
<br />487 Premises
<br />488 "Premises" means any land or building where Solid Waste, Recyclable Materials, or Organic
<br />489 Materials is generated or accumulated.
<br />490 Previous Contractor
<br />491 "Previous Contractor" means Allied Waste Services of San Mateo County, a division of Republic
<br />492 Services, Inc., which provided Collection services through December 31, 2010,
<br />493 Rates
<br />494 "Rates" means the monetary amounts to be charged a Customer by Contractor for providing
<br />495 Collection of Solid Waste, Recyclable Materials, Organic Materials, and other materials.
<br />496 Rate Year
<br />497 "Rate Year" means the twelve-month (12 -month) period, commencing January 1 of one year
<br />498 and concluding December 31 of the same year, for which Contractor's Compensation is
<br />499 calculated. For purposes of this Agreement, Rate Years are numbered consecutively starting
<br />500 with Rate Period Eleven (January 1, 2021 to December 31, 2021), thus reflecting a continuation
<br />501 of Rate Years One through Ten from the 2009 Franchise Agreement.
