ATTACHMENT K <br />CONTRACTOR'S COMPENSATION AND RATE SETTING PROCESS <br />Base Period — Current 1982-84=100 <br />Not seasonally adjusted <br />Periodicity— Bi -monthly <br />Series ID—CWURA422SAM <br />F. "Compensation Adjustment Factor" means the amount of change in the Contractor's <br />Compensation for the then -current Rate Year compared to the coming Rate Year. <br />G. "Potential Cap Carry Forward" means the amount of Member Agency's share of Contractor's <br />Compensation for the coming Rate Year that Member Agency may elect to defer (carry forward) <br />to the subsequent Rate Year, which is calculated as provided in Section S. <br />H. "Cap Carry Forward" means the amount that Member Agency actually elects to defer (carry <br />forward) from the coming Rate Year to the subsequent Rate Year pursuant to Section 5, which <br />shall be included in Member Agency's share of Contractor's Compensation as an adjustment for <br />such subsequent Rate Year. <br />I. "Direct Cost' means those costs directly attributable to the provision of Collection services <br />including, but not limited to, costs for Collection vehicle personnel and related benefits, payroll <br />taxes, and workers compensation insurance; Collection vehicle fuel; and other direct costs. <br />J. "Indirect Cost" means those costs not directly attributable to provision of Collection service, <br />which costs are aggregated into an overhead cost pool(s). Indirect costs include, but are not <br />limited to, costs for general and administrative, general operations, vehicle maintenance, and <br />container maintenance costs. <br />3. Contractor Accountability for Proposal Assumptions <br />The method of adjusting Contractor's Compensation holds Contractor accountable for several <br />projections and assumptions on which its projected 2021 costs were based, and which are <br />incorporated into the baseline costs shown on Attachment N, including: proposed technology, route <br />productivity, Single -Family Container placement assumptions, and Customer recycling/organics <br />participation rates, as follows: <br />• ProDosed Technology — No additional adjustments shall be made to Contractor's <br />Compensation if the technology proposed by Contractor does not achieve the intended results <br />or productivity. (If a Change in Law requires consideration of new or alternative technology or <br />if the Parties mutually agree to consider a change in technology, cost impacts related to the <br />change in technology will be addressed under the applicable provisions of the Agreement). <br />• Route Productivitv — The assumptions regarding route productivity directly impact costs <br />related to labor, route hours, vehicles, fuel use, and vehicle maintenance. No adjustments to <br />Contractor's Compensation will be made for differences between route productivity levels <br />assumed in Attachment N and actual route productivity. <br />• Customer Recvcling and Organic Program Participation Levels — Contractor's estimate of the <br />number of Single -Family Dwelling, Multi -Family, and Commercial Customers that will be <br />provided Targeted Recyclable Materials and Organic Materials Collection Service is <br />incorporated into the baseline costs shown on Attachment N.
