AMENDED AND RESTATED <br />FRANCHISE AGREEMENT <br />FOR <br />RECYCLABLE MATERIALS, ORGANIC MATERIALS, <br />AND SOLID WASTE <br />COLLECTION SERVICES <br />7 THIS AMENDED AND RESTATED AGREEMENT _("Agreement") is made as of this <br />8 day of , 2018, by and between the CITY OF REDWOOD CITY, a charter city <br />9 and municipal corporation ("Agency"), and RECOLOGY SAN MATEO COUNTY, a California <br />10 corporation ("Contractor"). <br />11 <br />RECITALS <br />12 This Agreement is entered into with reference to the following facts and circumstances: <br />13 <br />14 WHEREAS; the State of California has, through enactment of the California Integrated Waste <br />15 Management Act of 1989 ("Act"), determined each of the following: <br />16 A. That management of solid waste is a shared responsibility of the State and local <br />17 governments; <br />18 B. That it is in the public interest for local governments to be authorized and required to <br />19 provide adequate solid waste handling services; <br />20 C. That the amount of solid waste generated in California, coupled with diminishing landfill <br />21 space, potential adverse environmental impacts from landfilling solid waste, and the <br />22 need to conserve natural resources have created an urgent need for State and local <br />23 agencies to enact and implement an aggressive integrated waste management program; <br />24 and, <br />25 WHEREAS; the State of California, through the Act, has directed the responsible State agency <br />26 and all local agencies to maximize the use of feasible waste reduction, recycling, and <br />27 composting options in order to reduce the amount of solid waste that must be disposed of in <br />28 landfills; and, the State of California through AB 341, AB 1826, SB 1383, and other legislation <br />29 have established additional requirements for increased diversion of recyclable materials and <br />30 organic materials from landfill disposal; and, <br />31 WHEREAS; Agency is a member of the South Bayside Waste Management Authority <br />32 ("Authority" or "SBWMA"), established pursuant to the California Joint Exercise of Powers Act. <br />33 In November, 2007, the SBWMA, acting on behalf of Agency and its other members, issued a <br />34 Request for Proposals to provide collection of solid waste, recyclable materials, and organic <br />35 materials and related services to Agency and other members of SBWMA; and, <br />36 WHEREAS; on March 11, 2008, Contractor submitted a proposal to provide these services, <br />37 which was evaluated by the SBWMA; and, on the basis of that evaluation, the SBWMA <br />38 recommended that Agency enter into an agreement with Contractor; and, <br />IINVAIk6[:5B1LTA I <br />Page 1 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
