2795 questions or concerns, check the areas for contamination, litter, or damage and 2796 change the lock and distribute new "keyed alike" keys to Agency staff and 2797 Customers. 2798 8.06 PERSONNEL 2799 A. General. Contractor shall furnish such qualified drivers, mechanical, supervisory, 2800 customer service, clerical, and other personnel as may be necessary to provide the 2801 services required by this Agreement in a safe, thorough, professional, and efficient 2802 manner and shall provide, at a minimum, the number and type of personnel listed in 2803 Attachment O in total for the SBWMA Service Area. All personnel furnished by 2804 Contractor shall be subject to the "relationship of parties" provisions of Section 2805 15.01. 2806 B. Reserved. 2807 C. Collective Bargaining Agreements. If Contractor negotiates a new collective 2808 bargaining agreement with a union representing its employees, or an amendment to 2809 a collective bargaining agreement currently in force, either of which increases 2810 wages or benefits greater than wage and benefit costs included in Contractor's 2811 Compensation (through adjustments described in Article 11 and Attachment K), the 2812 Agency is not required to include costs attributable to the increased wages or 2813 benefits in Contractor's Compensation during the Term of the Agreement. 2814 D. Approval of Management. Contractor recognizes the importance of establishing a 2815 successful relationship between its management and Agency and SBWMA staff. 2816 Before extending an offer of employment for the position of general manager, both 2817 initially and throughout the Term, Contractor shall provide the SBWMA with the 2818 description of the proposed position; an opportunity to review and comment upon 2819 the position description, the background, experience, and qualifications of each 2820 candidate being considered for the position, and an opportunity to meet with each 2821 candidate. Contractor shall give thoughtful consideration to the SBWMA's 2822 comments on the descriptions of the proposed position and each candidate, but 2823 shall have the ultimate right to make employment decisions in its best business 2824 judgment. 2825 If the Agency is dissatisfied with the performance of the management personnel, the 2826 Agency shall contact the general manager to discuss the employee's performance. 2827 If the Agency is dissatisfied with the general manager, the Agency shall contact the 2828 group manager to discuss the general manager's performance. 2829 Contractor shall advise the affected management employee of any complaints 2830 made by the Agency regarding the employee's performance. The Parties shall 2831 meet and confer in good faith to address the Agency's concerns, and shall agree on 2832 a corrective course of action to be implemented immediately. Contractor agrees to 2833 consider in good faith, but shall not be bound by, any requests by the Agency to 2834 transfer or re -assign a management employee should the Agency maintain in good 2835 faith that it can no longer work constructively with said employee. 2836 E. Provision of Field Supervision. Contractor shall designate qualified employees 2837 as supervisors of field operations.
